HomeMy WebLinkAboutOrdinances Book 12, Page 1339, No Ordinance NumberAN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING AMID ZONING C -1:ISSIO11 RESPECTING THE REVISED PLAT OF SUBDIVISION OF TIIE PROPERTY KNMFI'I AS FOREST HILLS, APPROVING SAID PLAT AND SUBDIVIDING SAID PROPERTY 'WHEREAS pursuant to a resolution entitled: "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING AND ZONING COI-EEISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY OF 1-11DWEST 1.70IRTGAGE CO1.1PANY ADJACENT 7D THE RESERVOIR PROPERTY OF THE PADUCAH MTER WORKS", adopted by the Paducah Planning and Zoning Commission on August 14,,1952, and an ordinance entitled: "Ali ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING AND ZONING COIJUJISSION RESPECTING THE SUBDIVISION OF PROPERTY OF MIDI:NEST 1'IORTGAGE COMPANY ADJACENT TO THE RESERVOIR PROPERTY OF THE PADUCAH :'LATER WORKS, APPROVING THE PLAT OF SAID SUBDIVISION AND SUBDIVIDING SAID PROPERTY', adopted by this Board on August 14, 1952, a plat of subdivision of property of Midwest mortgage Company (now Forest Hills, Incorpora known as "Forest Hills", 26cated adjacent to the City reservoir property, was approved, subject to limited modifications as more fully set forth in said resolution and ordinance, and subject to the submission of a plat showing the changes subsequently effected, and WHEREAS certain changes in said subdivision have since been effected, all as shown by a revised plat submitted by the developers of said project, a copy of which is attached hereto, and WHEREAS said revised plat has been approved by the Paducah Planning and Zoning Commission, as is evidenced by its final report hereinafter referred to, NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COI -I ISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning and Zoning Commission on October 29, 1953, entitled: "A RESOLUTION CONSTITUTING THE FIIIAL REPORT OF THE PADUCAH PLAMNING AND ZONING CO1.2-11ISSION RESPECTING THE REVISED PKAT OF SUBDIVISION OF FOREST HILLS", be approved as the final report of said Commiss respecting the matters therein set forth. SECTION 2. "That the subdivision of property located in the City of Paducah, Kentucky and described as follows: Beginning at a point in the southerly line of the Georgia Ilae Nelson tract, said point of beginning being 564-37-44E 188.04 ft. from a concrete marker in the east right of way line of the Lone Oak Road, (U. S. J. Culler, C. E. and entitled 'Plat of Forest Bills", which plat has been approved by the Paducah Planning and Zoning Corwnission and bears the signature and acknowledgement of the Chairman of said Commission, be, and it is hereby approved, and said property is hereby declared to be subdivided as shovm on said plat. SECTION 3. That the street rights -of -sway dedicated and shown on said plat be, and they are hereby, accepted, but nothing herein contained shall constitute acceptance of public improvements, it being contemplated that acceptance of public improvements shall be accomplished by separate action of this Board. SECTIOI; 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect. any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. That this ordinance shall be in full force and effect from and after the date on which the aforesaid plat is lodged for record in the office of the Clerk of the McCracken County Court. e Passed by the Board of Commissioners November 17, 1953 Recorded by °a -rah Thurman, City Clerk, November 17, 1953.
