HomeMy WebLinkAbout2001-6-6364ORDINANCE NO. 2001-6- 6364 AN ORDINANCE AUTHORIZING THE SALE OF SURPLUS REAL PROPERTY FOR THE BENEFIT OF PADUCAH WATER WORKS WHEREAS, Municipal Order No. 889 was adopted by the Board of Commissioners on May 8, 2001, approving the Resolution of the Commissioners of Water Works of the City of Paducah declaring property located on Kimberly Drive no longer suitable or necessary to the operation of the Water Works; and WHEREAS, at a meeting held on May 30, 2001, the Commissioners of Water Works recommended that the City of Paducah accept the offer of David M. Paxton and Karen M. Paxton dated May 24, 2001, to purchase surplus property located on Kimberly Drive for the sum of Ten Thousand One Hundred Dollars ($10,100.00); and WHEREAS, the Commissioners of Water Works have declared the proceeds from the sale of this property are needed to continue the efficient operation of the Water Works, and it would be in the best public interest to sell same; and WHEREAS, said property is presently owned by the City of Paducah, Kentucky, on behalf of Paducah Water Works. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The City of Paducah hereby accepts the offer of David M. Paxton and Karen M. Paxton dated May 24, 2001, to purchase for the sum of Ten Thousand One Hundred Dollars ($10,100.00) the real property more particularly described as follows: Being a tract of land located on the south side of Kimberly Court in the City of Paducah, McCracken County, Kentucky, said tract of land being more particularly described as follows: Beginning at the northeasterly corner of the 14.27 acre tract purchased by party of the first part from Irene Bergerman Keiler, executrix, etc., et al, as shown by deed dated November 7, 1962, and recorded in Deed Book 440, page 391, McCracken County Court Clerk's Office which corner is in the line of property now owned by Cole Estate; thence South 30 degrees 01 minute 30 seconds West, and along the easterly boundary of said 14.27 acre tract, 125 feet; thence with an interior angle of 77 degrees 37.5 minutes and in a northwesterly direction 125 feet; thence with an interior angle of 102 degrees 22 %Z minutes and in a northeasterly direction 109.65 feet; thence with an interior angle of 257 degrees 37 V2 minutes and in a northwesterly direction 56.36 feet; thence at right angles and in a northeasterly direction 15 feet to a point in the northerly line of said 14.27 acre tract and at the easterly line of Riley Avenue; thence at right angles and in a southeasterly direction, and along the northerly line of said 14.27 acre tract, 178.1 feet to the point of beginning and containing approximately .37 acres. Also an easement for ingress and egress to the property thereby conveyed over the following described property, to -wit: Beginning at a point, the intersection of the easterly line of Riley Avenue and the northerly line of said 14.27 acre tract; thence at right angles to the said northerly line of the 14.27 acre tract and in a southwesterly direction and along the westerly line of the 79 premises hereinabove conveyed, 15 feet to a point; thence at right angles and in a northwesterly direction 50 feet to a point; thence at right angles and in a northeasterly direction 15 feet to a point, the intersection of the westerly line of Riley Avenue and the northerly line of said 14.27 acre tract; thence at right angles and in a southeasterly direction and with the northerly line of said 14.27 acres tract, 50 feet to the point of beginning. Being a part of the same property conveyed to the Board of Education of the Paducah Independent School District, Paducah, Kentucky, by deed dated November 2, 1962, and recorded in Deed Book 440, page 381, McCracken County Court Clerk's; and conveyed to the City of Paducah, Kentucky by deed dated October 12, 1964, and recorded in Deed Book 462, page 509, McCracken County Court Clerk's Office. SECTION 2. The City of Paducah hereby authorizes and directs the Mayor to execute and the Corporation Counsel to approve all deeds and any other documents necessary to accomplish the purposes of this ordinance and further authorizes the proceeds from this sale to be deposited in the Depreciation Account of Paducah Water Works. SECTION 3. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424.
