That Sections 1, 7, 8, 9 and 33 of an ordinance containing the title quoted above, which was adopted by the Board of Commissioners on December 2, 1947, and amended on October 21, 1952, October 28, 1952, November 18, 1952 and December 30, 1952, be, and the same are hereby repealed, amended and reordained so that said sections as amended and i 11111 reordained shall read as ,follows: "SECTION 1. Definitions. The following words and phrases as used in this ordinance, unless a different meaning is plainly shown by the context, shall have the following meaning: (a) "A-mployee" means any person employed in the conduct of municipal affairs, including the head of a department and each administrative employee appointed by the City Manager, with the exception of the Corporation Counsel, any Assistant Corporation Counsel, the Director of Public Works, the City Alcoholic Beverage Administrator, the Delinquent 1053 Tax Attorney, the City Physician (white) the City Physician (colored), the Dump 1/atchman, the Dog Catcher, the Janitor, the t/eighmaster, the Field - office Helper, and the term shall also no include the Rayor, a member of the Board of Commissioners, the City Manager, a member of the Police or Fire Department, a member, of the Board of Trustees of hte Policemen and Firemen's Pension Rand, with the exception of the City Treasurer who serves as ex - officio member, the City Planning and Zoning Board, the Board of Adjustment, City Planning and Zoning, the City of Paducah Municipal Housing Commission, the City of Paducah Aunicipal Hospital Commission, the Commissioners of the Paducah Water !forks, the Board of Trustees of the Public Library, or any employee of said boards of commissions,, or the trustees, members or corresponding officer of any similar boards or commissions of a city of the second class now or hereafter created, or any employee of such boards or commissions, or to any person employed on temporary and special projects, or to any person whose regular employment with the city is seasonal and is less than nine months in any one ye r, or to any other posttion heretofore or hereafter created which is specifically declared exempt from Civil Service. (b) "Appointing authority" means the officer, commission, board or body having the power of appointment or removal in any office, department, commission, board or institution. (c) "Civil Service" means the offices and positions of trust not specifically excluded by IfRS 90.310 or 90.410 or by ordinance of the city. (d) "Commission" means the board of Civil Service Commissioners as established under ?RS 90.310. (e) "Board of Trustees" shall mean the Board of Trustees of the Appointive EYnployees' Pension Fund created under the provisions of this ordinance. (f) "Pension ,fund" means the moneys derived from. the employees and the levy of a special tax, either or both, or by any other sumcbrived from any other source, to be used for the retirement of employees after the prescribed years of service and for the benefit of disabled employees, and widows and dependent children in the case of death of an employee within the scope of his employment according to the terms of nS 90.310 to 90.410 and the ordinances of the city. (g) "Widow" as used in this ordinance shall mean any woman legally married to an employee where there has been no decree of divorce dissolving the marriage and where the wife has not, at the time of the death of the employee, voluntarily abandoned him. 1054 Li DE g'13 "SECTION 7. I i 1057 "SECTION 33. This ordinance shall be known and referred to under a short title as "Appointive Employees? Civil Service Ordinance", and any amendments or changes hereafter shall refer to said ordinance by its short title aforesaid. If any section of this ordinance shall be held to be invalid or unconstitutional,% such fact shall not affect any other section of this ordinance, it being the intention of the Board of Commissioners in enacting this ordinance to enact each section separately." SECTIOTJ 2. The payment of salaries as herein provided including increases, shall be considered Current Departmental Expenses and shall be chargable to the accounts of each of said departments or divisions thereof as directed by the City Tianager, and payment therefor shall be provided for in the annual apportionment ordinance for the current year upon its adoption. All of the increases in salaries herein provided shall be retroactively effect andpayable from January 1, 1953. SECTION 3. All ordinances and parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION 4. This ordinance shall be in full force and effect from and after its adoption.
