FALLS 0011STRUCTION COMPANY OP TULSA, OKLAHOMA, IN T1 -f'7 AMOUNT OF ,5`1, 023, 527. 79 FOR FIVE (5) SECTI01✓S OF STORM SEWPR CONSTRUCTION IN THE CITY OF PADUCAH, PROVIDING IIAT THE MAYOR EXECUTE A CONTRACT ON BEHALF OF THE CITY OF PADUCAH WITH TME D. W. FALLS CON- STRUCTION COMPANY FOR SAID WORK AND PROVIDING THE TERNS AND CONDITIONS OF SAID CONTRACT: PROVIDING THAT SAID ACCEPTANCE OF SAID BID AWD CONTRACT FOR SAID WORK BE CONDITIONED UPON THE APPROVAL AND ACCEPTANCE THEREOF BY THE HOUSII✓G AND H0142 FINANCE AGENCY OF THE UNITED STATES OF AILRICA ;✓HiREASy the City of Paducah, Kentucky advertised for bids for the con- struction of certain storm sewers consisting of five (5) sections, to -wit: Noble Park Outfall Sewer; 30th Street Relief Sewer; 27th Street Relief Server; Cruse Avenue Sewer; and Branch Sewer; and WHEREAS, bids were submitted by contractors on.all or parts of said five sections in accordance with the "Notice to Contractors, Instruction to Bidders, Proposal Form, Bond Form, Contract Agreement Form, General Conditions, Special Conditions and Specifications for Storm Sewers" which was prepared by Black & Veatch, Consulting Engineers; and 61HEREAS, the lowest bid for the five (5) sections was in the amount of uI,023,527.79 and was submitted by D. 81. Falls Construction Company of Tulsa, Oklahoma which bid was lower than the lowest combination of all of the bids for individual sections of said sewer construction; and WHEREAS, said bid of D. W. Falls Construction Company is lower than the estimate made by the Engineer and it is believed that it should be accepted by said City if it is approved by the =,A of the United States of America. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COMISSIONERS OF THE, CITY OF PADUCAH, KENTUCKY. SECTION 1. That the City of Paducah, subject to the conditions herein set out, approve and accept the bid of the D. Y1. Falls Construction Company of Tulsa, Oklahoma in the total amount of $1,023,527.79 for the construction of five sections of a sewer system in the City of Paducah known by sections as follows: Noble Park Outfall Sewer; 30th Street Relief Server; 27th Street elief Sewer; Cruse Avenue Sewer and Branch Sewer. Approval and acceptance of said bid is subject to all the terms and condttions contained in the document on which said bidder based his bid on said work, this document having been prepared by Black & Veatch, Co nsulting Engineers of Kansas City,hiissouri and entitled "Notice to Contractors, Instruction to Bidders, Proposal Form, Bond Form, Contract Agreement Form, General Conditions, Special Conditions and Specifications for Storm Sewers". SECTION 2. Acceptance of the bid of D. W. Falls Construction Company and of the contract as set out in Section I shall be conditioned upon the final approval of the bid of said Jontractor and the authority to the City to enter 1012 into a Contract therefor f from the (FIFIFA of the United States of America and until said approval and authority is given and received neither the City nor the Contractor will be obligated except that each will be obligated to comply with the directions of said governmental agency and the decision of said agency shall be binding upon them. If final approval for the entire work by said contractor is granted by said governmental agency it is agreed that the parties will properly execute a contract or contracts containing all the terms of said Contractor's bid and the said contract shall be in the form of the contract in Black & Veatch's "Notice to Contractors, Instruction to Bidders, Proposal Form, Bond Form, Contract Agreement Form, General Conditions, Special Conditions and Specifications for Storm Sewers", and shall contain all the terms, specifica- tions and conditions thereof subject to such changes as may be required by the.HllF'A SECTION 3. It is further provided that said bid is accepted and said contract is authorized as herein provided subject to payment therefor from grants of money from the HHF'A and that said Contractor will be paid for said work from funds received from said grant and the City of Paducah shall in no wise be obligated under said contract for any payments out of any other revenues SECTION 4. They Mayor of the City of Paducah is hereby authorized to execute a contract, for and on behalf of the City of Paducah with D. W. Falls Construction Company of Tulsa, Oklahoma, said contract to contain all of the terms and conditions of this ordinance and such other terms and conditions as the Corporation Counsel of the City of Paducah may deem to the best interest of the City. SECTION 5. This ordinance shall be introduced and remain on file for public inspection for one week in the completed form in which is shall be put upon its final passage, and if adopted shall be in full force and effect ten (10) days thereafter.
