SECTION 1. For purposes of this ordinance the mord "garbage"
shall mean and include the organic wasto of animal, fish, fruit, or
vegetable matter arising from or attending the storage, doaling in,
preparation or cooking of food for human consumption from houses,
'.citchona, hotels, restaurants, stores, market and commission housos
and the word "rubbish" shall mean and include ashes, clinkers, cans
bottles, paper, boxes, creeds, leaves, ;rasa, br-.1,on crockery and
cimilar household trash, and any other kind of trash or waste
material except garbage, trees and tree limbs. A,

larger than 26 gallons in capacity; provided, hoc;over that rubbish
may be placed in other containers with the cona,�nt and approval of
said contractor. Said containers shall be placed on the ground

SY;'CTIO:; 5. It shall be unlawful for any person to place Crass,'
leaves, tree limbs, garbage, or any kind of rubbish in the ;,utter
of a street or anywhere -within a public xray, or to place container,
on a sideiaal:c or within any public way.
SECTION 6. It shall not be mandatory that citizens and reside is
of Paducah use and pay for the sorvicoo of the contractor holding
franchise contract with the city for collection and disposal of
garbago and ruobiah, provided they dispose of their garbage and
rubbish in strict compliance ti:i.t� all laws, ordinances, rules and
regulations governing such matters, now in effect or which may
hereafter be adopted or promulgated.
SECTION 7. It shall be unlawful for any person to dump arbag or
rubbish at any place within the city. except at the location or
locations used by the franchise contractor.
SECTION: 8. A violation of any provision or recuiremont of thi
ordinance is hereby declared to be a misdemeanor, and any person,
firm or corporation upon conviction of any such violation shall be
fined not less tl;an •:10.00 nor more than ,100.00, or shall be im-
prisoned not loss than five days nor more than SO days, or shall b
coth so fined and imprisoned, and each day that a violation
continues shall be deemed a sopara'o offense.
SECTION 9. If the contractor holding a franchise contract witt.
the city,or any or his employees or agents, violates any provision
of said contract, the contractor shall, upon conviction thereof, b
subjectto a .fine of not loss than ,;10.00 nor more than •,100.00 fo
each offcnso, and each day that a violation continues shall be a
separate offence.
