HomeMy WebLinkAboutOrdinances Book 11, Page 642, No Ordinance Number642 AN ORDINANCE ACCEPTING THE BID OF THC OHIO OIL COIPANY FOR TiiE SALE TO TILE CITY OF PADUCAIi OF THE 7,:C 1-2-3 LIQUID ASPHALT AND RC -3 LIQUID ASPHALT TO BE USED BY SAID CITY DURING THE YEAR 1949, AND AUTHORIZING THE CITY MANAGER TO ENTER INTO AND EXECUTE A CONTRACT FOR TIM PURCHASE OF SAID MATERIALS, AND PRESCRIBING THE TEP, S AND CONDITIONS UNDER WHICH SAID PURCHASES SHALL BE MADE WHEREAS, the City Manager has advertised for bids for liquid asphalt as required by the Resolution adopted by the Board of Commissioners on January 18, 1949, and the Ohio Oil Company being the only bidder on said contract, and WHEREAS, the City Manager having, recommended the accept- ance of the bid of the Ohio Oil Company; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COIICI- ISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the bid of the Ohio Oil Company for the sale to the City of Paducah of all MC 1-2-3 Liquid Asphalt and RC -3 Liquid Asphalt required by the City of Paducah during the year 1949 be accepted, and the City tlanager is hereby authorized to enter into and execute a contract for the purchase upon the order of said city of all asphalt to be used during the year 1949, said contract to contain the following terms, conditions and covenants: "The Company hereby agrees to sell and deliver to the City upon its order the IMC 1-2-3 and RC -3 Liquid Asphalt required in all repair and construction work during the remainder of the year 1949 at the prices and upon the terms set forth in said Company's bid as follows: MC 1-2-3 Liquid Asphalt, $0.1130 per gallon in tank car quantities (6,500 Fallon tank cars as desired) f.o.b. tank cars on City of Paducah track, Sixth and Campbell Streets, Paducah, Kentucky. Tank cars will be equipped with steam heater coils and if insulated tank cars are required, there will be additional charge of $6.00 per car per trip. RC -3 Liquid Asphalt, `;;0.1155 per gallon for delivery same manner as provided above for IMC asphalts. Asphalt tide propose to furnish will meet requirements of Kentucky State Highway Specifications for respective grades. Terra : Net thirty (30) days. "In consideration of the agreement of the City to purchase from the Company all of the aforesaid grades of asphalt required during the remainder of the year 1949, The Company agrees that the prices 1 0 ;for said asphalt shall not exceed the charges hereinabove provided, that in the event of a general advance in the retail price of (asphalt durin4: the aforesaid period the Company's obligation to sell and deliver asphalt at the aforesaid prices shall remain and 1 643 continue in full force and effect, but• in the event of a general decline in the price of said products the city %rill be given the benefit of the reduction in price." SECTION 2. This ordinance shall be introduced at a regular meeting of the Board of Commissioners and remain on file at least one (1) week for public inspection in the completed form in which it shall be put upon its final passage, and if adopted, it shall be in full force and effect ten (10) days thereafter.
