HomeMy WebLinkAboutOrdinances Book 11, Page 59, No Ordinance Number559 AN ORDINANCE PROVIDING FOR THE CLOSING OF 18711 STREET EXTENDING FROI.S THE NORTH PROPERTY LINE OF BROAD:'dAC TO THE SOUTH PROPERTC LINE OF JEFFERSON STREET IN 'rHE CITY OF PADUCAH, KEN'['UCKY AND AUTHORIZING THE CORPORATION COUNSEL TO INSTITUTE IN hCCRACKEN CIRCUIT COURT A SUIT ?OR THE PURPOSE OF HAVING SAID STREET CLOSED BY A JUDGEMENT OF SAID COURT WHEREAS, under a deed from it. H. ;feikel, etc., to the City of Paducah, Kentucky, dated December 22, 1908, and recorded i Deed Book 88, page 587, in the office of the County Court Clerk of McCracken County, Kentucky, Lots Nos. 5 and 22 in Block No. 1 of the Fountain Park Addition to the City of iaducah, Kentucky, was conveyed to said city for use in the establishment of a street to be known as 18th Street; and, 71HEREAS, under a deed executed by C. T. Allen, Single, to the City of Paducah, Kentucky, dated November 21, 1921, and of record in Deed Book 128, page 351, in the aforesaid Clerk's Office, Lots Nos. 5 and 22 3n Block No. 1 of the Fountain Park Addition to the City of iaducah, Kentucky, and 6 feet off of the East side of Lot No. 21 and Lot No. 4, and 4 feet off of the l°.est side of Lot No. 6 and Lot No. 23 in Block No. 1 of said Addition were conveyed to the City of Paducah for the purpose of opening a street running from Broadway to Jefferson Street and to be known as 18th Street; and, WH-iREAS, the aforesaid lots and parcels of land heretofore conveyed to the City of Paducah and dedicated for use as a public street have never been used for that purpose, and the establis tunent of a street running from Broadway to Jefferson Street will not affo any greater convenience for use by the traveling public, and the opening of said street is unnecessary; N0IN THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SEC TI ON 1. That the portions of 18th Street 60 feet in width extending from the North property line of Broadway to the South line of a 15 foot alley, and extending from the north line of said alley to the South line of Jefferson Street, the same having heretofore been dedicated for use as a public street, and being more particularly described as follows; to -wit: "Being Lots Nos 5 and 22 in Block No. 1 of the Fountain Park Addition to the City of iaducah, Kentucky, 6 feet off of the East side of Lot No. 21 and Lot No. 4, and 4 feet off of the West side of Lot No. 6 and Lot No. 23 in Llock No. 1, in Fountain Park Addition, as shown by a plat of said addition of record in Deed Book 38, page 147, in the office of the County Court Clerk of McCracken County, Kentucky; so and being the same property conveyed by C. T. Allen Single, to the City of Paducah, Kentucky, by deed dated November 21, 1921, and of record in Peed Book 128, page 351 in the aforesaid Clerk's Office." be and the same is hereby ordered to be closed, and the Corporation 41 Counsel is authorized and directed to institute in the McCracken Circuit Court a suit for the purpose of carryinZ the provisions of this ordinance into effect. SECTION 2.
