AN ORDINANCE REGULATING TILE SALE AiiD DISTRIBUTION OF
14ILK AND BILK PRODUCTS IN Tlh CITY OF PADUCAH BY ADOPTING THE
1939 EDITION OF THE MILK ORDIIIANOE AND CODE RECOMIJENDED BY TIRE
UNITED STATES PUBLIC HEALTH SERVICE, TOGETHER WITH ANY AMENDP,IEN TS
OR REVISIONS ?at'ICH HAVE BEEN OR MAY HEREAFTER BE ADOPTED AND
PUBLISHED BY THE UNITED STATES PUBLIC H'EALTH'SERV"ICE; PROVIDING
A SEVERABILITY CLAUSE ACID REPEALING ALL ORD INAIICES IN CONFLICT
HEREWITH; AND FIXING THE PENALTY FOR THE VIOLATION HEREOF
BE IT ORDAINED BY THE BOARD OF COi;IMISSIONERS OF THE
CITY OF PADUCAH, KENTUCKY:
SECTION 1.
That the 1939 Edition of the "k?ILK ORDINANCE AILD CODE"
Recommended By The United States Public Health Service, together
with Amendment No. 1 to Public Health Lulletin No. 220 (Adopted
by Public Health Service Sanitation Advisory Board July 1941)
and as said "'ilk Ordinance and Code may hereafter be amended or
revised, adopted .and published, is hereby adopted, and the pro-
visions thereof are hereby carried into full force and effect as
fully and to the same extent as if cited and copied in detail
in this ordinance, and a copy.of said Milk Ordinance and Code
is hereby filed with and as a part hereof, said copy to be treated
as a part of this ordinance to the same extent as if fully copied
herein and spread at large upon the ordinance book of the City of
Paducah.
SEC TIO:? 2.
Any person, firm, company, corporation or association
failing to comply with any provision of the aforesaid Ililk Ordinanc(
and Code shall be fined not less than :..10.00 nor more than ;100.00
for each violation thereof, and each time and each day such pro-
vision shall not be complied with shall constitute a separate offen:
SECTION 3.
If any section of this ordinance or any provision of the
aforesaid Milk Ordinance and Code shall be adjudged or held invalid
for any cause, it shall not thereby cause or result in the voiding
or invalidating of any other section of this ordinance or any otherl
provision of the aforesaid code. It is hereby declared as the
legislative intent that this ordinance would have been adopted and
.the aforesaid Milk Ordinance and Code would have.been adopted if such
void or invalid section or'provision had not been included therein.
SECTION 4.

All ordinances and parts of ordinances in conflict herewith
bare, to the extent of such conflict, hereby repealed.

SEC TIOIT 5.
This ordinance shall be in full force and effect from
and afterlits adoption.
