HomeMy WebLinkAboutOrdinances Book 11, Page 530, No Ordinance Number53� AN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING COMMISSION PROVIDING FOR THE ZONING •OF PROPERTY ON BOTH SIDES OF JEFFERSON STREET FROM 19TH STREET TO 28TH STREET FOR RESIDENTIAL PURPOSES, AND PP,ESCRIBI_dG THE PENALTY TO BE IMPOSED FOR VIOLATION OF THE RESTRICTIONS SET FORTH IN A RESOLUTION ADOPTED BY THE CITY PLANNING AND ZONING CO'.;i.iISSION ON MAY 21, 1948 BE IT ORDAINED BY THE BOARD OF COISII,IISSIONERS OF THE CIT! OF PADUCAH, KENTUCKY: SECTION 1. That upon the recommendation and request of the Il City Planning and Zoning Commission as shown by its final report 'embodied in a resolution adopted by it on May 21st, 1948, all of the property on both sides of Jefferson Street to the center line of the block on either side from the west property ;line of 19th Street to the east property line of 28th street liis hereby declared to be a residential district within the meaning of the City Planning and Zoning Commission Law and to be used for residential purposes only. SECTION 2. All property within said area is subject to the following restrictions: (1) All lots in the above mentioned tract shall be known land described as residential lots,used and maintained for residential purposes only and no structure shall be erected, altered, placed or permitted to remain on any residential building plot other than one detached single family or duplex apartment dwelling not to exceed two and one-half stories in height and a private garage for not mor than two cars. (2) No building shall be erected on any residential building plot nearer than 35 feet to the front lot line, nor nearer than 5 feet to any side lot line. No separate Garage or other outbuilding shall be located nearer than 125 feet to the front loi- line or nearer than 3 feet to any side lot line. (3) No residential lot shall be resubdivided into building plots having less than 7500 square feet of area or a width of less than 50 feet each. (4) No dwelling costing less than $10,000.00 shall be permitted on any lot in said tract and all residences shall front Jefferson Street. (5) No noxious or offensive trade or activity shall be carried on upon any lot nor shall anything be done thereon which me be or become an annoyance or nuisance to the neighborhood. (G) No basement, tent, shack, garage, barn or other outbuilding erected in the tract shall at any time be used as a residence temporarily or permanently, nor shall any residence of a temporary character be permitted. (7) No trailer shall be parked on any lot in this area, except that this section shall not prevent guests or visitors of Ithe residents of this area from occupying their own trailers for is period of not more than 30 days. SECTION 3. Any property owner, tenant or other person who erects, constructs or reconstructs any building in violation of or contrary to the aforesaid provisions of this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall 'be fined in any sum not less than y10,00 nor more than 9100.00 531 for each offense so committed and each day such offense is committ shall be deemed a separate offense and shall be subject to a separate penalty under the provisions hereof, or the person so offending or so guilty of violation of the provisions hereof, may in addition to such fine be imprisoned not more than fifty (50) days at the discretion of the Jud Re or Jury trying the case. SECTION 4. This ordinance shall be in full force and effect from and after its adoption.
