HomeMy WebLinkAboutOrdinances Book 11, Page 513, No Ordinance NumberAN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY AND ZONING COMMISSION PROVIDING FOR THE ZONING OF PERTY ON BOTH SIDES OF JEFFERSON STREET FROM 28TH STREET 31ST STREET FOR RESIDENTIAL PURPOSES, AND PRESCRIBING THE ALTY TO BE IMPOSED FOR VIOLATION OF THE RESTRICTIONS SET FORTH A RESOLUTION ADOPTED BY THE CITY PLANNING AND ZONING COMMISSION MAY 4, 1948 BE IT ORDAINED BY THE BOARD OF C014MISSIONERS OF THE CITY PADUCAH, KENTUCKY: SECTION 1. That upon the recommendation and request of the City lanning and Zoning Commission as shown by its final report mbodied in a resolution adopted by it on May 4, 1948, 11 of the property on both sides of Jefferson Street to the enter line of the block on either side from the west property ine of 28th street of the east property line of 31st street s hereby declared to be a residential district within the of the City Planning and Zoning Commission Law and to be for residential purposes only. SECTION 2. All property vi thin said area is subject to the following strictions: (1) All lots in the above-mentioned tract shall be known d described as residential lots, used and maintained for resi- ntial purposes only and no structure shall be erected, altered, aced or permitted to remain on any residential building plot her than one detached single family or duplex apartment dwelling t to exceed two and one-half stories in height and a private rage for not more than two cars. (2) No building shall be erected on any residential ilding plot nearer than 50 feet to the front lot line, nor nearer an 5 feet to any side lot line. No separate garage or other tbuilding shall be located nearer than 125 feet to the front lot ne or nearer than 3 feet to any side lot line. (3) No residential lot shall be resubdivided into building plots having le ss than 7500 square feet of area or a width of less than 50 feet each. (4) No dwelling costing less than $10,000.00 shall be permitted on any lot in said tract and all residences shall front Jefferson street. (5) No noxious or offensive trade or activity shall be arried on upon any lot nor shall anything be done thereon which ay be or become an annoyance or nuisance to the neighborhood. (S) No trailer, basement, tent, shack, garage, barn or other outbuilding erected on the tract shall at any time be used as a residence temporarily or permanently, nor shall any residence of s temporary character be permitted. SECTION 3. Any property owner, tenant or other person who erects, constructs or reconstructs any building in violation of or contrary to the aforesaid provisions of this ordinance, shall be 514 ;deemed guilty of a misdemeanor, and upon conviction thereof shall I be fined in any sum not less than Y$10.00 nor more than $100.00 for each offense so committed and each day such offense is commits shall be deemed a separate offense and shall be subject to a separate penalty under the provisions hereof, or the person so offending or so guilty of violation of the provisions hereof, may, in addition to s uch fine be imprisoned not more than fifty (50) days at the discretion of the Judge or Jury trying the case. SECTION 4.
