AACE OF PENSIONS AND OTHER BENE- FITS; APD PROVIDING A SEPARABILITY CLAUSE", which was adopted by the Zoard of Commissioners on December 2nd, 1947, be and the same is hereby amended so that said section as amended shall read as follows: "Section 1. Definition. The follov:•ing words and phrases as used in this ordinance, unless a different meaning is plainly shown the context, shall have the following meaning. (a) "Employee" means any person employed in the conduct of .unicipal affairs, including the head of a department and each dministrative employee appointed by the City Manager, with the ex- ception of the Corporation Counsel, the Assistant Corporation Counse pnd the City Alcoholic Beverage Administrator, but the term shall not include the Mayor, a member of the board of Commissioners, the City I.:anager, a member of the iolice or vire De a rtment, a membe lof the L'oard of Trustees of the iolicemen and �''iremen's Pension Fund isith the exception of the City Treasurer who serves as an ex -officio Lember, the City PlanninE. and Zoning Board, the Doard of Adjustment, ((City Plannin- and .oninC, the City of Paducah i4ainicipal Housing Comm- ission, the City of Paducah L:unicipatl Hospital Commission, the lommissioners of the Paducah "rater l'lorks, the Board of Trustees of t e (Public Library, or any employee of said boards or commissions, or th rustee, member or corresponding officer of any similar boards or ICommissions of a city of the second class now or hereafter created, r any employee of such boards or commissions, or to any person �mployed on temporary and special projects, or to any person whose egular employment with the city is seasonal and is less than nine onths in any one year. (b) "Appointing authority" means the officer, commission, board or body having the power of appointment or removal in any office, department, commission, board or institution. (c) "Civil service" means the offices and positions of trust not specifically excluded by Iia 90.510 to 90.410 or by ordinance of he city. 438 (d) "Commission' means the board of Civil Service Commissior ers as established under KRS 90.310. (e) "The Loard of Trustees" shall mean the i3oard of Trustees of The Appointive Employeest Pension Fund created under the provisi of this ordinance. (f) "Pension fund" means the moneys derived from the employe and the levy of a special tax, either or both, or any other sum de- rived from any other source, to be used for the retirement of employees after the prescribed years of service and for the benefit of disabled employees, and widows and dependent children in the cas of death of an employee within the scope of his employment accordin; to the terms of KRS 90.310 to 90.410 and the ordinances of the city (g) 1171idow" as used in this ordinance shall mean any woman legally married to an employee i;'cere there has been no decree of di' dissolving the marriage and where the wife has not, at the time of the death of the employee, voluntarily abandoned him." SECTION 2. All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTICi; 3.
