HomeMy WebLinkAboutOrdinances Book 11, Page 273, No Ordinance NumberAN ORDINANCE PROVIDING FOR AND REGULATING THE LICENSING AND INNOCULATION OF DOGS IN THE CITY OF PADUCAH, KENTUCKY; PROVIDIN FOR TIDE EMPLOYMENT OF VETERINARIANS TO ISSUE LICENSES FCR 1HE KEEPI OF DOGS; PROHIEITING THE aI NERS OR KEEPERS OF DOGS FRO:L ALLOINING SUCH DOGS TO BE AT LARGE; IMPOSING PENALTIES UPON OWNERS AND KEEPER OF DOGS FOR ME NON-PAYMENT OF LICENSE TAXES THEREON AND FOR THE VIOLATION OF THIS ORDINANCE; REPEALING ALL ORDINANCES Ii•: CONFLICT TIFERE'�iITH AND PROVIDING A SEPARABILITY CLAUSE. BE IT ORDAII4ED BY THE BOARD OF COMMISSIONERS OF THE CIT( OF PADUCAH, 3EN4UCKY: SEC TION 1. n / It shall be unlawful for any person, firm, company or cor- fXu'"a poration to own or keep a dog or dogs in the city of Paducah, Kentucky, without having first paid a license tax of ;1.25 for each dog so owned or kept and without having obtained a license for each dog so G l y owned or kept. The license tax for each dog so owned and kept shall be due and payable on the first day of January, 1948, for the perio ending December 31, 1948. On and after the first day of January 1, 1949, and on the first day of each succeeding year thereafter, any person, firm, company or corporation owning or keeping a dog or dogs shall obtain a license therefor and pay thereon a license tax of y1.25 for each dog or dogs so owned or kept in the city. Any person, firm or corporation acquiring a dog or dogs at any time after January 1 of any year shall pay a license tax of •pl.25 and obtain a license for each dog so acquired and kept, and the license or licenses shall be for the period ending on December 31 of the year in which such dog or do7,s were acquired. SECTION 2. The City Bianager is. hereby authorized to employ a sufficient number of veterinarians to innoculate dogs and to issue the license therefor, the veterinarian to receive for his services the sum of 13A, •;1.00 for each dog innoculated by him. Each veterinarian so employed shall deposit with the City Treasurer the sum of twenty-five (25�) cents for each license tag obtained by him. Upon the payment to him of the license fee of ;;1.25 by the owner of a dog, it shall be the duty of the veterinarian to innoculate such dog and deliver to the owner the license tag issued by the city together with a certificate showing that such dog has been immunized against rabies. Any lisense tag or tage which are not used may be returned to the City Treasurer who shall refund to the veterinarian the sum of twenty-five (25�) cents for each unused tag. SECTION 3. Any owner or keeper of a dog or dogs who prefers to have the innoculation done by a veterinarian not employed by the city may(, 274 by furnishing the City Treaaurer with a certificate of a licensed veterinarian t at such dog or dogs have been immunized against rabies add by paying a fee of twenty-five (25¢) cents for each dog which has been innoculated, obtain a license therefor. SECTION 4. The owner or keeper of a dog shall have such dog innoculated and no license shall be issued until such dog has been innoculated. Provided, however, if the owner or keeper of a dog prefers to have dog muzzled, the use of a muzzle will be permitted if of the kind approved by the veterinarians employed by the city. If a muzzle is continuously used, innoculation will not be required. All muzzles for dogs shall be procured at the expense of the owner or the keepe thereof, and the city shall.in no event be responsible for the expe of such muzzle. It shall be unlawful for the owner or keeper of any dog, either licensed or unlicensed to allow such dog to be at large and not restrained or confined in an enclosure. SECTION 6. When the owner or keeper has a dog innoculated, the city license 'tag delivered to such owner or keeper shall be fastened to the collar of the dog and shall be worn continuously and the failura to have such tag so attached shall subject the owner or keeper then of to the penalties provided in Section 6 hereof. SEC TION 7. Any dog found at large, either licensed or unlicensed shall be subject to be seized and impounded by the City of Paducah and such dog not claimed and whose release has not been procured within seven (7) days after its seizure, shall be subject to be disposed of in such manner as may be determined by the City Manager Any licensed dog may be redeemed and released to its owner or keeper within seven (7) days after being taken up and impounded, and for every licensed dog redeemed and released to its owner or 1te per there shall be paid to the City of Paducah a redemption fee of One ($1.00) Dollar and in addition, the sum of Twenty-five (25�) cents per day to cover the cost of keeping such dog while in the pound. If any dog so released has not been licensed, the sum of Two (.'2..00) Dollars shall be charged and One ($1.00) Dollar of the fee paid sha1 be expended for the purpose of having said dog innoculated at the t�me of its release, plus the sum of twenty-five (25�) per day to cover the cost of keeping such dog in the pouhd. n r 275 For the purpose of carrying this ordinance into effect, any police officer or any person especially employed or appointed for that purpose may seize and impouhd any dor found at large. SECTION 8. Any person being the owner or keeper of a do.- who fails to pay on or before T+:arch 31 the license required by this ordinance or who permits such dog to be at large, or who fails to have such dog innoculated or muzzled, shall upon conviction be fined not less than 615.00 nor more than '25.00. SEC TION 9. All funds derived from licenses issued under the provisions of this ordinance or from fines for the violation of the provisions hereof shall be paid into the treasury of the city and shall become a part of its general fund for public purposes. SECTION 10. All ordinances and parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed. SECTION 11. If any section, part of a section, sentence, clause, or phrase of this ordinance shall be held unconstitutional or invalid, Ithe remaining provisions hereof shall nevertheless remain in full force and effect. SECTION 12.
