HomeMy WebLinkAboutOrdinances Book 11, Page 229, No Ordinance Number-f - 22R AN ORDINANCE PROVIDING FOR THE CLOSING OF THAT PORTION OF A 26.5 FOOT ALLEY RUNNING 129.94 FEET WEST OF THE WEST LINE OF NORTH FIFTH STREET BETWEEN FIFTH AND SIXTH STREETS IN THE CITY OF I PADUCAH; DESCRIBING SPECIFICALLY THAT PORTION OF SAID ALLEY TO BE CLOSED; AND AUT[iORIZING THE CORPORATION COUNSEL TO INSTITUTE IN MCCRACKEN CIRCUIT COURT A SUIT FOR THE PURPOSE OF CARRYING THIS ORDINANCE INTO EFFECT. BE IT ORDAINED BY THE BOARD OF COI&MISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SEC TION 1. That the City of Paducah hereby authorizes the closing of that portion of a 26.5 foot alley which runs 129.94 feet west of the west line of North Fifth Street in the City of Paducah, Kentucky, which portion of said public alley to be closed is more particularly described as follows: "Beginning at a point where the south property line of a 26.5 foot alley intersects the west property line of 5th Street, said point being 160 feet north of the north- west corner of the intersection of 5th Street and Park Avenue; thence in a westerly direction parallel with Park Avenue and with the south property line of said alley 129.94 feet; thence in a northerly direction parallel with 5th Street 26.5 feet to the north property line of said alley; thence in an easterly direction with the north pro- perty line of said alley 129.94 feet to the west property line of 5th Street; bheUce in a southerly direction and with the west property line of 5th Street 26.5 feet to the point of beginning" And the Corporation Counsel is hereby directed to institute in the McCracken Circuit Court a suit for the purpose of obtaining a judg- ment providing for the closing of said alley. SECTION 2. The aforesaid alley shall be closed upon the condition that a right of way or easement is reserved at all times for floodwall maintenance, for purposes of ingress and egress, 20 feet west of and parallel with the center line of the floodwall. SECTION 3. 11 This ordinance shall be in full force and effect from and after its adoption.
