I FOR TIS 17MPLOYHENT OF AN AT ORMEY FOR RECOVERY OF TAXES UPON I� OMITTED PROPERTY, A:M PRESCRIBING THE TEMIS AIM CONDITIONS TO BE CONTAINED IN SAID CONTRACT BE IT RESOLVED BY TIE BOARD OF COPAMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City Manager be and he is hereby authorized to enter into and execute for and on behalf of the city of Paducah a contract with an Attorney for the collection and recovery by suit of any taxes which may be due the City of Paducah upon omitted property. Said Attorney shall institute and prosecute such suits as may be necessary to recover taxes upon property omitted from assessments, subject to taxation by the City of Paducah for any and all of the past five (5) years. The compensation Cor his services shall be an amount equal to one-third of whatever taxes, penalties and interest are actually recovered by him or through proceedings instituted or prosecuted by him for the City of Paducah'- but aducah;but the r ate of compensation shall attach only to the taxes, interest and penalties and that pact of same which belongs to the City and 1 form a part of its revenue and income, but shall not attach to any f taxes, penalties and interest recovered for, the benefit of the Board of Education or the Sinking Funds, or for any other independent or separate purposes where the city itself is required to collect and pay over such taxes for such independent agencies or purposes. I SECTION 2. Said Attorney shall each thirty (30) days after his employment hereunder render an itemized statement of all cases i II and claims on which he is contemplating the commencement of 11 actiond or proceedings for assessment of property or recovery i of taxes, which report shall show the name and residence of each person, firm or corporation claimed to be .liable for such taxes r and whihh statement shall be verified under oath. Nhen said i, statement is received the same shall become and be a public I� itrecord and be filed with the Board of Commissioners and a copy furnished to the City Assessor. 6 SECTION 3. I� All money collected by said attorney through his efforts i; and the proceedings instituted by him shall be paid directly to I. the City Treasurer by the party or barties from wham such money is collected. 864 SECTION 4. The person employed shall be a regular practicing Attoaney of the City of Paducah, and his employment may be terminated by the City Manager at any time. In the event his employment is terminated, the right of said attorney to such compensation as may be due upon all items of taxable property in any action or proceeding commenced by him prior to the termination of his contract of employment shall not be affected. SECTION 5. This resolution shall be in full Force and effect from and after its adoption.
