HomeMy WebLinkAboutOrdinances Book 10, Page 845, No Resolution Numbere 845 A RESOLUTION AUTHORIZING THE EXECUTION OF A BILL OF SALE CONVEYING TO WAR MATERIALS, INC., AGENT FOR METALS RESERVE COMPANY, ALL STREET CAR RAILS, TRACK FASTENINGS AND OTHER METALLIC MATERIAL OWNED BY THE CITY OF PADUCAH, THE SAME TO BE CONVEYED AND MADE I'j AVAILABLE FOR WAR USE, AND PRESCRILING THE CONDITIONS UNDER WHICH �i SAID RAILS SHALL BE REMOVED WHEREAS, the City of Paducah, Kentucky, is the owner of jcertain street car rails, track fastenings, and other metallic track 1i material lying in the streets of said city, which are shown on Exhibit "A"• and "B" annexed hereto; and, j i WHEREAS, said rails, track fastenings, and other metallis' track material, are vitally necessary to the prosecution of the present war; and, WHEREAS, the City desires as a contribution to the war effort', jto make said tails, track fastenings, and other metallic track 'Imaterial immediately available for war use; I NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. THAT Pierce E. Lackey, the Mayor, be and he hereby is authorized on behalf of the city, to convey title to said rails, track fastenings and other metallic track material to WAR MATERIALS, INC., Agent for% i Metals Reserve Company, by bill of sale, the form of which shall be approved by the City Attorney. I QP.r+mTnu n WAR MATERIALS INC., Agent for Metals Reserve Company, be and it hereby is given permission, itself or through others, to remove the above said rails, track fastenings, and other metallic track material, and for that purpose to disturb the pavement in the' streets where said rails are located, provided that the slots from which the rail is removed are refilled with's suitable available paving material. The work of removing the rails and refilling i the slots shall be carried out in accordance with specifications mutually acceptable to WAR MATERIALS, INC., Agent, as aforesaid, and the City Engineer. The lattdr shall assure himself that the work is to be done with minimum interference with the movement of traffic. SECTION 3. Any and all liability of any nature whatsoever of v1AR MATERIALS, INC., as Agent, shall cease and terminate unless claim shall be made in writing to WAR MATERIALS, INC., by the official specified ` Z _.t' 846 in Section 2 hereof, within thirty days after written notice of com- pletion of work has been given to said official by 'NAR T�ATERIALS, INC., SECTION 4. The title to any rails which are not removed by WAR MATERIALS, IND., for the purposes above stated shall not be conveyed by bill of sale but shall remain vested in the City. SECTION 5.
