THAT IIE T,AY CONTINUE TO SERVE AS CITY MANAGER 17HEREA3, the Mayor has received from the Attorney General of the Commonwealth of Kentucky an opinion stating that a City Manager must be a resident of the city in which he serves, and that the maintenance of a residence outside the corporate limits would be in violation of Section 234 of the Constitution of the State of Kentucky:and, WHEREAS, James P. Smith, L:anager of the City of Paducah, does not reside in the City; and, 1'.'HEREAS, the Attorney General has further advised that by reason of the insistance of one organization that he file a suit t ,to oust the said .James P. Smith from office, he believes it is his duty to institute an ouster proceeding unless the City Manager establishes a residence in the city at this time; and, 17HEREAS, by reason of Mr. Smithfs outstanding q_ualificat:ioj�s las an executive, his devotion to duty and loyalty to the City of � I Paducah, and the envialbe record which he has made durin.the last i ;three years, as .,,-ell as the impossibility of securing the services o.i anyone as well qualified to perform the duties of that office, the members of the Board of Commissioners are convinced that it vioull be for the best interest of the people of the City if Mr. Smith �7uld continue to serve; and, � I ;VIIEREAS, the members of the Board also fully realize that 1:r. Smith made great personal sacrifices when he accepted the appointment, and that he has attained his goal by administering the financial affairs in such manner as to pay off entirely a floating indebtednes of 11;o3,184.09 which was owing when he accepted the position in 'January 1940, and to close each of the years 1940, 1941 and 1942 I with a substantial surplus. Nevertheless the interest of the citizens nd taxpayers being at stake, the members of the Board are hopeful i That he is willing to make ever greater sacrificed by establishing residence in the city and by continuing, to serve as its Manager. NO71, THEREFORE, BE IT .RESOLVED BY `"HE BOARD OF IOMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: ! SECTION 1. That James P. imith, Manager of the City of Faducah, be rrged to establish and maintain a residence within the corporate IIII: limits of the City in order that he may continue to serve as I 816 Liamager, and in order that the people may be assured of the continued efficient, orderly and economic managemcnt of governmental affairs. SECTION 2. This Resolution shall be in full force and effoct f.1,om ;and after its adoption.
