V' AN ORDINANCE ASSESSING THE ABUTTING PROPERTY ON rOTH SIDES OF CLARK STREET FROM THE WEST PROPERTY LINE OF 7TH STREET TO THE EAST PROPERTY LINE OF MURRELL BOULEVARD IN THE CITY OF PADUCAH, MCCRACKEN COUNTY, KENTUCKY, FOR THE PORTION OF THE COST OF CON- STRUCTION OF SAID STREET AND IMPROVEMENT THEREOF, BY THE PLACING THEREIN AND THEREON OF A CONCRETE SURFACE TOGETHER S,'ITH ALL NECESSARY CURBS, GUTTERS, DRIVEWAYS, MANHOLES, INTAKES, CATCH BASINS, SE6VER AND DRAIN PIPES AND ALL NECESSARY ENGINEERING, EQUIPMENT, ADVERTISING AND LEGAL AND CLERICAL SERVICES IN CONNECTION THEREWITH UNDER THE PROVISIONS OF AN ACT OF THE GENERAL ASSEMBLY OF THE C014MON'HEALTH OF KENTUCKY ADOPTED AT ITS REGULAR SESSION IN 1938 PROVIDING FOR THE IMPROVEMENT OF PUBLIC 'PLAYS IN CITIES OF THE SECOND CLASS BY AID OF THE WORK PROJECTS ADMINISTRATION OR OTHER AGENCIES OF THE FEDERAL OR STATE GOVERN- MENT, AND AT THE EXCLUSIVE COST OF THE OWiiERS OF REAL ESTATE ABUTTING ON SUCH IMPROVEI,IENT ACCORDING TO THE NUMBER OF FRONT OR ABUTTING FEET, AND PROVIDI_dG THAT A TAX SHALL BELEVIED UPON SAID LOTS OR PARCELS OF REAL ESTATE FOR THE PAYMENT OF THE COST ASSESSED THEREON, I"iHICH COST SHALL BE THE DIFFERENCE BETWEEN THE TOTAL COST OF COMPLETING SAID IMPROVEMENT AND THE TOTAL AMOUNT OF THE CONTRIBUTION OF THE WORK PROJECTS ADMINISTRATION OR OTHER AGENCIES OF THE FEDERAL OR STATE GOVERNMENT ENGAGED IN MAKING SAID IMPROVEI:SENT, ANI` WHICH TAX SIIALL BE D E AND PA CABLE AT THE OFFICE OF THE CITY TREASURER IN THE CITY HALL IN PADUCAH, AND ONEwHALR OF THE ',ORK RAVING BEEN COMPLE-TED AND THE ESTIMATED COST ASCERTItINED, AND IT BEING DETERMINED FROM SAID ESTIM�'.TES AFTER DEDUCTING 7HE AMOUNT TO BE CONTRIBUTED BY THE WORK PROJECTS DDI+IINISTRATION OF THE UNITED STATES THAT THE AMOUNT REQUIRED TO BE CONTRIBUTED BY THE ABUTTING RROPERTY OWNERS ON CLARK STREET BETcVEEN 7TH STREET AND 9TH STREET IS �p1.90 PER FRONT FOOT FOR STREET PAVING; ALL CURBS SHALL BE $0.30 PER LINEAT FOOT; ALL GUTTERS SHALL BE .';',O.20 PER LINEAT FOOT; DRIVEWAYS SHALL BE $0.12 PER SQUARE FOOT; AND ON CLARK STREET BETfiEEN 9TH STREET A M MiU"RELL BOULEGARD THE AMOUNT SHALL BE $2.15 BER FRONT FOOT FOR STREET PAVING, and ',IHEREAS, the Board of Commissioners has heretofore adopted an ordinance providing for the construction and reconstruction of said driveway, under the terms of said Act aforesaid, and pursuant to itx providions; and, WHEREAS, work on said improvement has been half completed and hereby declared by the Board of Commissioners to have been half completed on and before this date, and the estimated cost thereof is noe due to be paid to the City Treasurer, and the first half thereof having been assessed at the time of commencement of 'f4 745 I ,said work, and the last half is due to be assessed when the work is half completed, i Li NOW, THEREFORE, BE I'.P ORDAIIQED BY THE BOARD OF COM14ISSIONERS OF THE CITY OF PADUCAH, KENTUGICY: SECTION 1. That all of the property on both sides of Clark itreet from the lVest property line of 7th Street to the East property line of Murrell Boulevard in the City of Paducah, McCracken County, Kentucky, as shown by estimates on file in theEngineer's office in rhe City I Hall in the City of Paducah, Kentucky, be and the same is hereby assessed for the cost of construction of said paved street with all necessary curbs, gutters, driveways, manholes, intakes, catch basins, sewer and drain pipes and all necessary engineering, eq- uipment, advertising and legal and clerical services in connection therewith, the portion of said cost of improvement required to be � paid by said property owners shall be the following amount per front foot; to -wit: Total cost against the property owners between 7th and 9th Streets is :;*1.90 per front foot for street paving; all curbs shall be .^0.30 p g; per linear foot; all gutters shall be $0.20 per lineab foot, all driveways shall be X0.12 per i squate foot; and between 9th Street and 14urrell Bouleaard the amount for street paving shall be ti�2.15 per front foot; that all of said estimates are on file in the office of the Engineering j Department in the City Hall, and are referred to and made a part I hereof. I SECTION 2. I i That one-half of said assessments as against each lot as I shown by said assessamnt and estimate of said Engineer was due at the commencement of said work and has heretofore been assessed, and the ' Board of Commissioners having by this ordinance determined that said work has been half completed and the last half of said assess -'i ment is now due to be paid, said last half shall ba paid within ten (10) days after the adoption of this ordinance and unless so maid there shall be added thereot a penalty of 61d. and a lien is declared to exist upon said lots and parcels of real estate for thel proprotionate cost of said improvements so assessed as herein I provided in addition to the assessment far the first half of the cost thereof as hereinbefore made; and the amount of said assessment shall bear interest upon any part thereof that remains unpaid for ten (10) days after the same is due to be paid as herein 3 provided at the rate of 6% per annum in addition to the penalty ` aforesaid, which lien shall be superior to all other liens except the liens for State, County and City taxes. li i 746 i it SECTION 3. The publication of this ordinance shall be notice to all persons interested and due to pay said assessment, of the time and place to pay the same. Said assessment will be paid within ten (10) days from the publication of this ordinance. SECTION 4. This ordinance shall be in full force and effect from and after its adoption.
