REPRESENVATIVE AND STROTHER MELTON, STATE SENATOR FRONS THIS j
COUNTY, FOR THEIR VIGOROUS SUPPORT OF HOUSE BILL NO. 146 RELATING
TO THE ESTABLISHMENT AND OPERATION OF ELECTRIC POWER SYSTEM+IS AND
FACILITIES BY CITIES AND COUNTIES
WHEREAS, the Tennessee Valley Authortty has declared that
it will be in position to supply a large section of Western Ken-
tucky, including Paducah, with low-cost electric power by 1944; and,
WHEREAS, the Kentucky Court of Appeals has ruled that Kentucky
municipalities do not have authority to enter into contracts
with the Tennessee Valley Authority for electric power under j
existing statutes; and,
WHEREAS, since the theory and policy of the Tennessee
Valley Authority and the Act of Congress which created it are
that the Authority is to act as a wholesaler, selling power gen-
erated by it to distribution systems owned and operated by munic-
ipalities and non-profit cooperative associations, legislation
to provide the methods by which municipalities in Kentucky may

acquire and operate the necessary distribution systems, and to
authorize such municipalities to enter into the type of power
contract required by the Tennessee Valley Authority Act, is es-
sential if residents of municipalities in the Kentucky area to j
i
be served by TVA are to benefit by its low-cost power opportunities;

OF THE CITY OF PADUCAH, KC',TTUCKY:
SECTION 1.
That the City of Paducah approve the adoption of legislation
permitting municipalities to enter into contracts with the

Tennessee Valley Authority for the purchase of electrie power
without imposing any restrictions upon their right to contract
therefor; that the City of Paducah oppose any provision in such
i
enabling legislation which will grant to the Kentucky Public Service
,,ommission any powers whatever in connection with the purchase
of electric energy by contract or the acquisition and operation of
electric distribution systems by municipalities; and that Henry
Ward, State Representative from this County be commended for
intorducing and vigorously supporting a bill which will enable this
city to own and operate a municipal liCht and power plant or to
purchase power from the Tannessee Valley Authority without placing
upon it restrictions of any kind.

SECTION 2.
This Resolution shall be in full force and effect from
and after its adoption.
