HomeMy WebLinkAboutOrdinances Book 10, Page 559, No Ordinance NumberPage 559- , AN ORDINANCE AI:IENDING AILD RE -ORDAINING SECTION 1 OF AN ORDINAI.CE ENTITLED: "AN ORDINANCE REGULATING AND DEFINING SPEED OF VEHICLES UPON GRAVEL STREETS IN THE CI'iY OP PADUCAH, AND i PRESCRIBING PENALTIES FOR VIOLATION THEREOF", WHICH PJAS ADOPTED BY THE BOARD OF COIJMISSIONERS ON THE 16TH DAY OF AUGUST, 1937, AND AFTERWARDS A119ENDED ON THE 23RD DAY OF AUGUST, 1937, SO THAT SAID SECTION SHALL READ AS HEREINAFTER PROVIDED BE IT ORDAINED BY THE BOARD OF COMMS SSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Section 1 of an ordinance entitled, "AN ORDINANCE REGULATING AND DEFINING SPEED OF VEfIICLES UPON GRAVEL STREETS IN THE I CITY OF PADUCAH, AND PRESCRIBING PENALTIES FOR VIOLATION THEREOF", which was adopted by the Board of Commissioners on the 16th day of August 1937, and afterwards amended on the 23rd day of August 1937, be and the same is hereby amended and re -ordained so that said Section as so amended and re -ordained shall r ead as follows: "The stirring up of dust on the gravel streets in the City of Paducah by rapidly moving vehicles is hereby declared to be a menace and danger to the public health of all people in the City of Paducah, and especially to the people residing on and along', all of the gravel streets of said City, and other streets where dust may be stirred up and formed into dust clouds by the rapid movements of vehicles. It is further declared that the rapid moving vehicles! which move at a speed greater than fifteen (15) miles per hour cause and produce great clouds of dust which are swept into the homes and residences of persons residing in the vicinity of where said dust is 'thus stirred up, and in order to prevent said dust from being so stirred up so that the same menaces the lives and health of people, no person operating a vehicle of any kind on any gravel ; street or streets covered partly with gravel and partly with dirt, shall move or transport same at a greater rate of speed than ,fifteen (15) miles per hour; provided, however, that when said streets are wet or when the surface has been treated with oil or dust 'settling process, the provisions of this ordinance shall not apply. Any person so operating an automobile on said gravel or partly gravel street at a greater rate of spped than fifteen (15) miles per hour, except as herein provided, shall be fined in any sum not less than ,p5.00 nor more than '-25.00." Page 560 SECTION 2. II All ordinances and parts of ordinances in conflict i,herewith are, to the extent of such conflict hereby repealed. III SECTION 3.
