That the driveway on Caldwell Street from the West property !line of 11th Street to the East property line of 12th Street in the i 'City of Paducah, Kentucky, with all necessary manholes, intakes, catch basins, sewer and drain pipes and all necessary engineering, I equipment, advertisi.n,; and legal and clerical services in connection therewith, under an Act of the r,eneral Assembly of the Commonwealth of Kentucky adopted at its rerular session in 1938, providing for the improvement of public ways in cities of the second class by� aid of the Work Projects Administration or other Agencies of the Federal or State Government, and at the exclusive cost of the owners! I of real estate abutti_n on such improvement to be aopor•tioned on such Improvement accordin-. to the number of front or abutting feet, and pr•ovidin_; that a tar, shall be levied upon said lots or par:•ers of real estate for the payment of the cost assessed thereon, and which cost shall be the difference between the total cost of comoletin; said i improvement and the total amount of the contribution of the Work Projects Administration or other a-�ancies of the Federal or State �e '/ 7 Y Government enraged in makIn said improvement, and which Lax shall be due and payable at the office of the City Treasurer one-half thereof when the work bf construction beg^^ins and the remainder thereof when one-half of said improvement has been completed, which time shall be determined by the Board of Commissioners of said city with the advice ,of the city Engineer, be and the same is hereby ordered to be ::Ving constructed and rec nstructed with concrete or other improved (material under the provisions of said law aforesaid. I SEC! IO?; 2. That all the cost incident to said construction of sad stre t as provided in Section 1 hereof, except that part which shall be paid by the Federal or -tate Government shall be paid for wholly by the property owners of property abuttin or frontin- upon such improvement on both sides of'sa_d street, and to be apportioned to and assessed against said abutting property as provided in Section I hereof. SE,CTIOi< 3. When said work has been commenced, the Board of Commissioner ith the advice of the City En,l-ineer shall cause to be given to the owners of said property abutting upon such improvement so proposed to be made, a notice by the publication of' an ordinance or ('resolution that said work has commenced, and upon the publication of such resolution or ordinance the owners of such abutting propert (shall immediately pay to the City Creasurer the amount of one-half of the estimated cost of such improvement as may be apportioned to 'I said respective lots so abuttin- thereupon, and when said work has been half completed said Board of Commissioners shall likewise pub- lish a resolution or ordinance giving notice of the half completion thereof, and requiring the or:mers of the abuttin" property thereon to pay into the City Treasury the other one-half of said cost of said improvement so to be assessed a3ainst said property and appropriated thereto as aforesaid, and which payments shall be made immediately upon the publication of such notices as herein 1provided. SECTION 4. This ordinance shall be introduced at a re;.,ular meetin; of the Board of Commissioners, and remain on file for not less than Ione (1) week for public inspection in its completed form in which lI it shall be put upon its f Lnal passa e, and upon its adoption it shall be in full force and effect ten (10) days thereafter.
