That the dmiveway on Caldwell Street from the :,`est property lin i' of 11th Street to the East property line of 12th Street in the City of Paducah, Kentucky, be constructed and reconstructed of a concrete or such other inproved pavin,- material as may be approved i by the 'hoard of Commissioners of the City of Paducah, with all necessary manholes, intakes, catch vasins, sewer and drain pipes and all necessary en:;ineerin;, equipment, adver•tisinR and le_ -al and clerical services in connection therewith, and all to be done under and pursuant to statute authorizin, such improvements, and pursuant thereto that said improvement oi' such public way shall be made b; the ','ork Projects Administration or other a-encies of the ederal or State Government at the exclusive cost of the owners of the real estate abutting on said improvement to be apportioned among Page 468 I and assessed upon the lots or parcels or' real estate abuttinn on such improvepient accordinZ to the number of front of, abutting- feet, and a tax shall be levied upon said lots and parcels of real estate for, the payment of the cost assessed Lrioreon, which cost shall be the difference between the total cost of completin,, said improvement a. -ICL the total amount of the contribution of said Federal or State ASencies en -,a_ -ed in maki.n8 said improvements, and which tax shall be due and payable at the office of the City Treasurer, one-half, there- of when the work of construction be. -ins and the remainder thereof or one-half of said cost when one -calf of said improvement shall have I!been completed, and which time shall be determined by the 'oard of �l Commissioners of said city w[ th the adiice of the City En,-ineer, !land no property shall be exempt from such improvement tax, provided, however, that any assessment for any such improvements as provided . ifor herein :dhich exceeds one-half of the value of the lots or parcels l II of real estate i.pon which the assessment is made shall be void as to such excess, but the improvements shall be taken :into consideration in fixing the %aloe of such real estate, and the Board of !!Commissioners shall provide for the payment of any such excess, 1', if any, out of the _;eneral funds. This resolution, after its adoption shall be published in at least one (1) issue of the official newspaper of the City of Padu.cat, at least seven (7) days before any ordinance ordering said improvement shall have its final passage.
