SAID CITY YdITiI THE ADVICE OF THE CITY E.GINEER WHEREAS, it is deemed and is hereby declared to be a necessity chat the driveway on isiurrell Boulevard from the South property line of Tennessee Street to the North property line of Jones Street in the City of Paducah, Kentucky, be constructed and reconstructed of improved p paving material under the provisions of lav a-oplicable i to cities of the second class,- NOVY, 'THEREFORE, _ BE IT RESOLVED BY THE BOARD OF COI.1TISSIONERS OF THE CITY OF PADUCAH , KENTUCKY: SECTION 1. That the driveway on 1h9urrell Boulevard from the South property line of Tennessee Street to the L'orth property line of Jones Street in the City of Paducah, Kentucky, be constructed and reconstructed: of a concrete or such other improved pavin, material as may be approved by the Board of Commissioners of the City of Paducah, nr i t. -t all necessary manholes, intakes, catch basins, sewer and drain pipes . and all necessary engineering, equipment, advertising and le�al and clerical services in connection therewith, and all to be done under and pursuant to statute authorizing, such improvements, and pursuant i t'Zereto that said improvement of such public way shall be made by the ;vork Projects Administration or other agencies of the Federal or State Government at the exclusive cost of the owners of the real i Pa-e 458 estate abutting on said improvement to be apportioned among and it assessed upon the lots or parcels of real estate abutting on such I i 1' improvement according to t; e number of front or abuttinnt feet, and �I a tax shall be levied upon said lots and parcels of real estate f'or, the payment of the cost assessed thereon, which cost shall be the ost of completing said improvement difference between the total c and the total amount of the contribution of said Federal or State Agencies engoged in making; said improvements, and vfnich tax sha .1 b;e i due and payable at the office of the City Treasurer, one-half thereiof when the viork of construction beZins and the remainder thereonf of one-half of said cost when one-half of said improvement shall have i been completed, and which time shall be determined by the °•oard of Commissioners of said city with the ad rice of the City Znr.ineer, and no property shall be exempt from such improvement tax, provided, however, that any assessment for any such improvements as provided for herein which exceeds one-half of the value of the lots or parcels of real estate upon w hick the assessment is made shall be void as to such excess, but the improvements shall be taken into i consideration in fixing the value of such real estate, and the Board of Commissioners shall provide for the payment of any such excess, if any, out of the general funds. it SECTIOIN 2. This resolution, after its adoption shall be published in at least one (1) issue of the official news-paper of the City of Paducah at least seven (7) days before any ordinance orderin.,, said improvement shall have its final passage. I SECTION 3. This resolution shall be in full force and e;,;ffect from i) and after its adoption by the Board of Commissioners and upon 11 its publication as herein provided.
