HomeMy WebLinkAboutOrdinances Book 10, Page 321, No Ordinance NumberPage 321 AN ORDINANCE ASSESSING THE ABUTTING PROPERTY ON BOTH SIDES II OF MADISON STREET FII) 14 THE WEST IR OPERTY LINE OF 9TH STREET TO ME EAST PROPERTY LINE OF 16TII S`.Ift'ET, EXCLUDING INTERSECTION AT I i; 13TH STREET IN THE CITY OF PADUCAH, MCCRACKEN COUNTY, KENTUCKY, i �I.FOR 'RIE PORTION OF THE COST OF CONSTRUCTION OF SAID STREET AND is IMPROVEMENT THEREOF, BY ME PLACING THEREIN AND THEREON OF A CONCRETE SURFACE TOGETHER WITH ALL NECESSARY MANHOLES, INTAKES, CATCH BASINS, SEWER AND DRAIN PIPES AND ALL NECESSARY ENGINEERING, ADVER- TISING AND LEGAL AND CLERICAL SERVICES IN CONNECTION TIEREWITH UNDER THE PROVISIONS OF AN ACT OF THE GENERAL ASSEMBLY OF THE COMMONWEALTH OF KENTUCKY ADOPTED AT ITS REGULAR SESSION IPI 1938, PROVIDING FOR THE IMPROVEMENT OF PU LIC WAYS IN CITIES OF THE SECOND CLASS BY AID OF THE WORK PROJECTS ADMINISTRATION OR OTHER AGENCIES OF THE FEDERAL OR STATE GOVERNMENT, AND AT THE EXCLUSIVE COST OF THE OWNERS OF REAL ESTATE ABUTTING ON SUCH IMPROV24ENT ACCORDING TO THE NUMBER OF FRONT OR ABUTTING.PEET, AND PROVIDING THAT A TAX SHALL BE LEVIED UPON SAID LOTS OR PARCELS OF REAL ESTATE FOR THE PAYMENT OF THE COST ASSESSED' 'i THEREON, WHICH COST SHALL BE THE DIFFERENCE BETWEEN THE TOTAL COST 'i OF COMPLETING SAID IMPROVEMIENT AND THE TOTAL AMOUNT OF THE CONTRIBUTION j OF THE WORK PROJECTS ADMINISTRATION OR OTHER AGENCIES OF THE FEDERAL i OR STATE GOVERNMENT ENGAGED IN MAKING SAID IMPROVEMENT, AND WHICH TAXES SHALL BE DUE AND PAYABLE AT THE OFFICE OF THE CITY TREASURER IN THE CITY HALL IN PADUCAH, ONE-HALF THEREOF MEN THE WORK OF CONSTRUCTION BEGINS AND THE REI,AINDER THEREOF WHEN ONE -IL ALF OF SAID IMPROME'ENTS SHALL HAVE BEEN COI.TPLETED, WHICH TIME SHALL BE DETER- ISiINED BY THE BOARD OF COMMISSIONERS WITH THE ADVICE OF THE CITY ENGINEER; AND ALL THE ENGINEERING WORK HAVING BEEN COMPLETED AND THE ESTIMATED COST ASCERTAINED, AND IT BEING DETE.RT'IINED FROMS AID ESTIMATES AFTER DEDUCTING THE AMOUNT TO BE CONTRIBUTED BY THE WORK PROJECTS ADMINISTRATION OF THE UNITED STATES THAT THE AMOUNT REQUIRED TO BE CONTRIBUTED BY THE ABUTTING PROPERTY OWNERS ON MADISON SaREET BETVILEN 8TH STREET AND 16TH STREET IS $2..15 PER ABUTTING FOOT; AND THE CITY OF PADUCAH BEING NOW READY TO COMMENCE WORK ON SAID IMPROVEMENT AS OF THE DATE OF THE ADOPTION OF THIS ORDINANCE, j WHEREAS, the Board of Commissioners has heretofore adopted: I! an ordinance providing for the construction and reconstruction of said driveway under the terms of said Act aforesaid and pursuant to its provisions, and, WHEREAS work is now ready , a y to begin on said d construe i ton and one-half of the estimated cost thereof is now due to be paid to the City Treasurer, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY; SECTION 1. i Page 322 That all of the property on both sides of Madison Street from the gest property line of 9th Street tothe East property line of 16th Street, excluding intersection at 13 Street in the CitY of Paducah, McCracken County, Kentucky, as shown by estimates on file in the Engineers' office in the City Hall in the City of Paducah, Kentucky, be and the same is hereby assessed for the cost of construction of said paved street with all necessary manholes, intakes, catch basins, sewer and drain pipes and all necessary engineering, advertising and legal and clerical services in connection therewith, the portion of said cost of improvement required to be paid by said property owners shall be the following amount per front foot, to -wit: `Ictal cost against the property owners between 9th and 16th Streets is $2.15 per abutting foot; that all of said estimates are on file in the office of the Engineering Department in the City Hall, and are referred to and made a part hereof. SECTION 2. That one-half of said assessment as against each lot as shown by said assessment and estimate of said enineer is now due and unless paid within ten (10) days after the adoption of this ordinance there shall be added thereto a penalty of 61 and a lien is declared to exist upon said lots and parcels of real estate for the portion of cost of said improvement so assessed as herein provided, and the amount of said assessment shall bear interest upon any part thereof that remains unpaid for ten (10) days after same is due to be paid at the rate of 6% per annum in addition to the penalties afore- said, which lien shall be superior to all other liens except the lien for State, County and city taxes. SECTION 3. The publication of this ordinance shAll be notice to all persons interested and due to pay said assessment, of the time and Place to pay the same. Said assessment will be paid one-half within ten (10) days from the publication of this ordinance, and the other one-half will be paid when the Board of Commissioners shall declare, by ordinance or resolution, that said work and said improvement has been one-half completed. SECTION 4.
