HomeMy WebLinkAboutOrdinances Book 10, Page 296, No Ordinance NumberAN ORDINANCE PROVIDING RULES REGULATING THE HOURS DURING WHICH GATES SHALL BE PdAINTAINED AND FLAGMEN SHALL BE STATIONED AT INTERSECTIONS CROSSED BY THE RAILROAD TRACKS WITHIN THE CITY OF PADUCAH, AND PRESCRIBING THE PENALTIES FOR VIOLATION THEREOF WHEREAS, under an ordinance adopted by the Board of Commissioners on October 25, 1907, as will be shown in Revised � ✓ �� Ordinance Book, page 371, the General Counsel of the City oC s Paducah is authorized to designate by ordinance the public highways and streets crossings on which railroad companies are required to erect and maintain a gate or gates or electric Sones and signals, and one or both, and the time same shall be erected; and, NOW, THEREFORE, BE IT ORDAINED BY `IIIE BOARD OF C01,1I'+SSSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION I. That the railroad company which owns the right of way at Eleventh & Broadway Streets shall operate and maintain at all times between the hours of 7:00 o'clock A.Ml. and 1:00 o'clock A.i. of each day suitable gates at said crossing for the purpose of warning the traveling public on Broadway Street of the danger of crossing the tracks when engins or trains are being operated thereon, but it shall not be necessary for said Company to employ a flagman to operate said gates between the hours of 1:00 o'clock A.M. and 7:00 o'clock A.M. if said company shall station at said intersection a member of the train crew who shall give sufficient warning of the approach of an engine or train when such warning is necessary. SECTION 2. E That the railroad company owning the rights of gray at the hereinafter mentioned crossings shall be required to employ, between the hours of 4100 o'clock P.M. and 12:00 o'clock midnight, a flagman at its railroad crossings at 8th & Park --Avenue and 9th and Clay Streets, and the glagman assigned to duty at each of said crossings shall give sufficient warning of the approach of an engine or train when such warning is necessary. SECTION 3. For any violation of the terms of this ordinanve by the Railroad Company, or by its employees, said Company shall be guilty of a misdemeanor for which it shall be fined an amount of nor less than $5.00 nor more than $100.00 for each offense An the Police Court of the City of Paducah, and such fine so assessed shall be collected as any other .fines assessed against a corporation. Page 29'7 SECTION 4. All ordinances and parts of ordinances in conflict herewith ,are to the extent of such conflict hereby r epealed. SECTION 5.
