HomeMy WebLinkAboutOrdinances Book 10, Page 245, No Ordinance NumberPage 245 AN ORDINANCE PROVIDING FOR THE CONSTRUCTION AND RECONSTRUCTIC OF THE CONCRETE SIDEWALKS, DRIVEWAYS WITH CURB RETURNS AND CROSS WALKS ON BOTH SIDES OF HARAHAN BOULEVARD FROM TIE NORTH PROPERTY LINE OF JEFFERSON STREET TO THE SOUTH PROPERTY LINE OF CLAY STREET II IN THE CITY OF PADUCAH, MCCRACKEN COUNTY, KENTUCKY, WITH ALL I NECESSARY DRAIN PIPES, AND ALL NECESSARY ENGINEERING, ADVERTISING AND LEGAL AI4D CLERICAL SERVICES IPI CONNECTION THEREWITH,IIPDER THE PROVISIONS OF AN ACT OF THE GENERAL ASSEMBLY OF THE COYMION- I' WEALTH OF K=NTUCHY ADOPTED AT ITS REGULAR SESSION IN 1938 iiPROVIDING FOR THE IMPROVEMENT OF PUBLIC 7r'AYS IN CITIES OF THE SECOND CLASS BY AID OF THE WORK PROJECTS ADIINISTRATION OR OTHER i AGENCIES OF THE FEDERAL OR STATE GOVERNMENT, AND AT THE EXCLUSIVE COST OF ME OlFINERS OF REAL ESTATE ABUTTING ON SUCH IMPROVEMIENT I ACCORDING TO THE NUMBER OF FRONT OR ABUTTING FEET, AND PROVIDING I THAT A TAX SHALL BE LEVIED UPON SAID LOTS OR PARCELS OF REAL I � ESTATE FOR THE PAYMENT OF THE COST ASSESSED THEREON AND WHICH COST SHALL BE THE DIFFERENCE BEMEEN TF_E TOTAL COST OF COMPLETING I I SAID IMPROVEMENTS AND THE TOTAL AIriOUNT OF THE CONTRIBUTION OF THE WORK PROJECTS ADMINISTRATION OR OTHER AGENCIES OF THE FEDERAL OR STATE GOVERNITNT ENGAGED IN MAKING SAID IMPROVEMENT, AND WHICH, TAXI SHALL BE DUE AND PAYABLE AT THE OFFICE OF THE CITY TREASURER, ONE -I i HALF THEREOF WHEN THE 7-ORK OF CONSTRUCTION BEGINS AND ME REMAINDER I THEREON WHEN ONE-HALF OF SAID II-rPROVEMiENTS SHALL HAVE BEEN COI+IPLET ED, WHICH TIME SHALL BE DETERfINED BY THE BOARD OF COh:MISSIONERS WITH THE ADVICE OF THE CITY ENGINEER. BE IT ORDAINED BY ME BOARD OF COY14ISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the sidewalks, driveways with curb returns and cross walks on both sides of Harahan Boulevard fro m the North property line of Jefferson Street to the South property line of Clay Street in the City of Paducah, Kentucky, with all necessary drain pipes, and all necessary engineering, advertising and legal and clerical services in connection therewith, under an Act of the General Assembly of the Commonwealth of Kentucky adopted at its Regular Session in 1938, providing for the improvement of publj ways in cities of the second class by aid of the Work Projects Administration or other Agencies of the Federal or State Government and at the exclusive cost of the owners of real estate abutting on such improvement to be appropriated on such improvement according . to the number of front or abutting feet, and providing that a tax shall be levied upon said lots or parcels of real estate for the payment of the cost assessed thereon, and which cost shall be the I difference between the total cost of completing said improvement Page 246 gnd the total amount of the contribution of the work Projects Administration or other Agencies of the Federal or State Government engaged in making said improvement, and which tax shall be due and: i payable at the office of the City Treasurer one-half thereof when the work of construction begins and the remainder thereof when one- half of said improvement has been completed, which time shall be determined by the Board of Commissioners of said city with the advice of the City Engineer, be and the same is hereby ordered to be so constructed and reconstructed with concrete or other improved paving material under the provisions of said law aforesaid. SECTION 2. That all the cost incident to said construction of said sidewalks, driveways and cross walks as provided in Section 1 here- of, except that part which shall be paid by the Federal or State Government shall be paid for wholly by the property ovn ers of property abutting or fronting upon such improvement on both sides of said street, and to be apportioned to and assessed against said abutting property as provided in Section 1 hereof. SECTION 3. !Then said work has been commenced, the Board of Commissioners, Ali with the ad -!vice of the City Engineer shall cause to be given to the owners of said property abutting upon such improvement so proposed to be made, a notice by the publication of an ordinance or resolution that said work has commenced, and upon the publication of such resolution or ordinance the owners of such abutting property shall immediately pay to the City Treasurer the amount of.one-half of the estimated cost of such improvement as I may be appropriated to said respective lots so abutting thereupon, and when said work has been half completed said Board of Commissioners shall likewise publish a resolution or ordinance i giving notice of the half completion thereof, and requiring the owners of the abutting property thereon to pay into the City Treasury the other one-half of said cost of said improvement so to be assessed against said property and apportioned thereto as aforesaid, and which payments shall be made immediately upon the publication of such notices as herein provided. SECTION 4. IIIn or der to prevent possible accidental injuries to persons who now use said sidewalks, and in order to preserve jmaintain and protect the public health and safety of the City of Paducatt and its citizens, an emergency is hereby declared to exist II Page 247 and this ordinance shall be in full force and effect fm m and adter its adoption.
