HomeMy WebLinkAboutOrdinances Book 10, Page 237, No Resolution NumberPage 237 A RESOLUTION AUTHORIZING THE CITY 14ANAGER TO ENTER INTO AND EXECUTE, FOR AND ON BEHALF OF THE CITY OF PADUCAH, A CONTRACT FOR THE EMPLOYMENT OF AN ATTORNEY, ATTORNEYS, COLLECTOR OR COLLECTION AGENCY FOR T!-1E COLLECTION ON A CONTINGENT FEE BASIS OF ALL PERSONAL PROPERTY TAX BILLS, AS WELL AS ALL SEAL ESTATE TAX BILLS IN AMOUNTS NOT EXCEEDING 0100.00, AND PRESC:iIBING THE TERMS AIM CONDITIONS TO BE CONTAINED IN SAID CONTRACT WHEREAS, there has accumulated a very large amount of delinquent personal property tax bills representing assessments due and owing to the City of Paducah; and, WHEREAS, there are also a number of unpaid real estate tax bills wherein the amount due the City of Paducah is less than P100.00, and in view of the Court Costs required to be incurred for the enforcement of the city's lien against such property, it would be expensive to resort to foreclosure in order to enforce the payment of such delinquent real estate assessments, and, WHEREAS, by reason of the amount of work which the legal department is required to do in the filing and prosecution of suits for . satisfaction of real estate tax claims involving more than 0100,00, it is unable to efficiently handle the collection of personal property taxes and real estate tax claims involving less than $100.00; NOVI, THEREFORE, BE IT RESOLVED By HE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City Manager be, and he is authorized to enter into and execute, for and on behalf of the City of Paducah, a contract with any attorney, attorneys, collector or collection agency for l the collection of allpersonal property tax bills and all real estate tax bills in amounts not exceeding 0100.00, said contract to provide the payment for the services of such collector on a contingent fee basis. The fee agreed upon shall not in any event exceed a sum equal to 25% of the taxes, interest and penalties collected, and the City of Paducah shall not incur any Court Costs� of other litigation expense without the approval of the City Manager. SECTION 2, Said Collector shall execute and deliver to the City of Paducah a bond in the sum of 01,000-00 with corporate surety approved by the City Manager for the use and benefit of the City of Paducah for the faithful Performance of his duties, and the faithful accounting of all funds coming into his Page 238 hands and under his control. SECTION 3. j The City Manager shall have the right to terminate the employment of said Collector at any time and without notice, but in the event said employment shall be terminated, he shall be entitled to receive the proportionate share of such collections which are made by the City of Paducah as the result of the settlement of any suits or the adjustment of a claim in any case wherein a demand for payment has been made by said Collector prior ' to his removal from office. SECTION 4.
