HomeMy WebLinkAboutOrdinances Book 10, Page 228, No Resolution NumberPage 228 v A RESOLUTION CERTIFYING EXPENDITURE OF FUNDS FOR ACQUISITION OF FLOOD WALL RIGHT OF WAY, AND CERTIFYING FIRIMY OBLIGATED FUNDS FOR FLOOD WALL RIGHT OF 1`IAY, AND CERTIFYING OBLIGATIONS NOT YET BINDING FOR FLOOD WALL RIGHT OF WAY, AND CALLING UPON DISTRICT ENGINEER OF `RiE LOUISVILLE DISTRICT AND THE FEDERAL GOVERNMENT FOR ADDITIONAL FUIDS FOR FLOOD WALL RIGHT OF ;NAY PURPOSES. WHEREAS, under the plans of procedure approved for the Paducah Flood Wall project, it is contemplated that the 1$200,000.00 proceeds of the bond issue sold by the City of Paducah for the purpose of providing funds for the purchase of right of way would if necessary be supplemented by the Federal Government to the extent of such amount not exceeding 1$160,000.00 as might be required for the acquisition of the necessary right of way upon which to construct the Paducah Flood Wall, and WHEREAS, under the plans of procedure it is necessary that the City expend or firmly obligate all of its funds before Federal funds can be made available and at such time as call for Federal funds is made it is necessary that the City certify to the District Engineer of the Louisville District the obligation of its funds and the need for addi- tional funds, together with citation of reason for such call, NOW, THEREFORE, BE IT RESOLVED that it is hereby certified to the District Engineer of the Louisville District that the City of Paducah has expended to March 5th, 1940 in acquisition of right of way the sum of $166,671.51, and that it has firmly obligated itself for the acquisition of further and other right of way in the sum of fi60,637.78, and that there exist obligations not yet binding upon the City, repre- sented by options not yet exercised by the City and not yet approved by the District Engineer for right of way, in the sum of $25,940.00. The aggregate amount expended, oblig- ated and of obligations not yet binding equals {3253,249.29, which exceeds by 1$53,249.29 the said sum of $'i200,000.00. BE IT FURTHER RESOLVED that it is further certified to the said District Engineer that the said sum of $53,249.29 above referred to be necessarily expended nf� in the acquisition of further right of way necessary for the Paducah Flood Wall and formal request is hereby made for Federal funds in said amount. Page 229 BE IT FURTHER RESOLVED MIAT it is certified to the said District Engineer that said sum of money will not he sufficient to acquire all additional right of way necessary and that further call for Federal funds will be made when other and further obligations have come into existence. BE IT FURTHER RESOLVED that the City Manager is authorized, empowered and directed to furnish such certi- ficates and evidence as may be required by the District Engineer in support of the foregoing resolution.
