HomeMy WebLinkAboutOrdinances Book 10, Page 194, No Ordinance NumberPage 194 AN ORDINANCE AUTHORIZING THE UNITED STATES OF AMERICA, ITS OFFICERS, ENGINEERS, AGENTS AND EMPLOYEES TO ENTER UPON LANDS HERETOFORE ACQUIRED OR HEREAFTER ACQUIRED BY THE CITY OF i PADUCAH FOR USE IN CONNECTION WITH THE CONSTRUCTION OF A SEA WALL OR FLOOD PROTECTION WALL IN SECTION "A" AND SECTION "B", AND TO EXERCISE ALL RIGHTS AND PRIVILEGES GRANTED TO SAID CITY OF PADUCAH UNDER AND BY VIRTUE OF THE CONVEYANCES, I LICENSES, GRANTS AND EASEMENTS HERETOFORE ACQUIRED OTS HEREAFTER ACQUIRED, BY SAID CITY FROM THE 0>n2IERS OR OCCUPANTS OF THE r' LANDS OVER, ACROSS AND THROUGH WHICH SAID SEA WALL OR FLOOD PROTECTION WALL WILL BE CONSTRUCTED, AND AUTHORIZING THE MAYOR OF THE CITY OF PADUCAH TO EXECUTE FOR AND ON BEHALF OF SAID CITY AUTHORIZATION OF ENTRY AGREEMENTS FOR THE PURPOSES HEREIN STATED. WHEREAS, the City of Paducah has acquired and will acquire by conveyances, grants, licenses and easements and under judgments entered in condemnation proceedings instituted I in the McCracken Circuit Court all rights of way and privileges necessary for the construction and maintenance of a sea wall or flood protection wall in Section "A" and Section "B" as will be shown by plat of said sea wall or flood protection . wall on file in the office of the United States Engineers at Paducah, Kentucky and in the office of the City Manager of Paducah, Kentucky, and, WHEREAS, the United States of America has agreed to proceed with the construction of said sea-v.all or flood pro- tection wall upon the execution of authorization of entry agreements by duly authorized officers of the City of Paducah granting to the United States of America, its officers, engineers, agents and employees, the riSht of entry upon the rights of way for the purpose of constructing said sea-wall of flood protection wall. NOW, THEREFORE, BE IT ORDAINED B`r THE BOARD OF COPdMISSTONERS OF THE CITY OF PADUCAH, KENTUCKY: li SECTION 1. That the United States of America, its officers, agents, engineers and employees, are hereby authorized to Pa3e 195 I I I enter upon all lands heretofore acquired or hereafter acquired I by the City of Paducah for use in connection with the construc- tion of a sea-wall or flood protection wall in Section "A" and II in Section "B", and to exercise all rights and privileges under and by virtue of the conveyances, grants, licenses and easements heretofore acquired or hereafter acquired by the j City of Paducah from the owners or occupants of the lands i over, across and through which said sea-wall or flood protec- tion wall in Section "A`" and in Section "B" will be constructed in accordance with the plans and specifications as shown by I plat on file in the office of the United States Engineers in i Paducah, Kentucky and in the office of the City i:'anager of I 2aducah, Kentucky. SECTION 2. That Pierce E. Lackey, Mayor of the City of Paducah, I I be and he is hereby authorized .ti execute for and on behalf of I the City authorization of entry agreements granting unto the I United Sates of America, its officers, engineers, agents and employees, the rights and privileges as provided uider Section 1 hereof. SECTION 3. This ordinance shall be in full force and effect from and after its adoption. Pierce E.
