HomeMy WebLinkAboutOrdinances Book 10, Page 191, No Ordinance NumberPage 191 AN ORDINANCE PROVIDING FOR THE CONSTRUCTION AND RECON- STRUCTION OF THE DRIVEWAY ON I,IONROE STREET FROk1 THE WEST PROPERTY LINE OF 13TH STREET TO THE EAST PROPERTY LINE OF 17TH STREET, E:CLU'DING INTERSECTION AT 16TH STREET IN THE CITY OF PADUCAH, M.CCRACKEN COUNTY, KENTUCKY, WITH ALL NECESSARY MANHOLES, INTAKES it CATCH BASINS, SEWER AND DRAIN PIPES, AND ALL NECESSARY ENGINEERING, ADVERTISING AND LEGAL AND CLERICAL SERVICES IPI CONNECTION TiIERE- WITH, UNDER THE PROVISIONS OF AN ACT OF THE GE! dERAL ASSEMBLY i OF THE CO1,:MOIP.7EALTH OF KENTUCKY ADOPTED AT ITS REGULAR SESSION IN 1938 PROVIDING FOR THE IMPROVET:ENT OF PUBLIC WAYS IN CITIES OF THE SECOND CLASS BY AID OF THE IKORK PROJECTS ADMINISTRATION OR OTHER AGENCIES OF THE FEDERAL OR STATE GOVERNMENT, AND AT THE EXCLUSIVE i i COST OF THE 07,TiERS OF REAL ESTATE ABUTTING OPi SUCH IPLPROVEIIENT I, ACCORDING TO THE NUMBER OF FRONT OR ABUTTING FEET, AND PROVIDING I i THAT A TAX SHALL BE LEVIED UPON SAID LOTS OR PARCELS OF REAL ESTATE FOR THE PAYP:E_;T OF THE COST ASSESSED THEREON AND WHICH COST SHALL BE THE DIFFERENCE BETNEEN THE TOTAL COST OF COI:-2LETING I� SAID IKPROVEMENTS AND THE TOTAL AMOUNT OF EHE CONTRIBUTION OF THE WORK PROJECTS ADMINISTRATION OR OTHER AGENCIES OF THE FEDERAL OR STATE GOVERNMENT ENGAGED IN MAKING SAID IMPROVEMENT, AND WHICH TAX SHALL BE DUE AND PAYABLE AT THE OFFICE OF THE CITY TREASURER, i ONE-HALF THEREOF WHEN THE 'i,'ORK OF CONSTRUCTION BEGINS AND THE REP,AINDER THEREOF WHEN UNE -HALF OF SAID IMPROVEMENTS SHALL HAVE BEEN C OMPLETED, WHICH TIME SHALL BE DETERI!INED BY THE BOARD OF i COMMISSIONERS WITH THE ADVICE OF THE CITY ENGINEER I BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITrY OF PADUCAH, KENTUCKY: SECTION 1. That the driveway on Monroe Street from the ';Jest property line of 13th Street to the East property line of 17th Street, excluding intersection at 16th Street in the City of Paducah, Kentucky, with all necessary manholes, intakes, catch basins, sewer and drain pipes, and all necessary engineering, advertising and legal and clerical services in connection therewith, under an Act of the General Assembly of the Commonwealth of Kentucky adopted at its Regular session in 1938, providing for the improvement of public ways in cities of the second class by aid of the Work Projects Administration or other Agencies of the Federal or State Government, and at the exclusive cost of the owners of real estate abutting on such improvement to be apportioned on such improvement according to the number of front or abutting feet, i and providing that a tax shall be levied upon said lots or parcels of real estate for the payment of the cost assessed thereon, r I{ and which cost shall be the difference between the total cost of completing said improvement and the total amount of the contribution of the Work Projects Administration or other Agencies of the Federal or State Government engaged in making said improvement, and which tax shall be due and payable at the office of the City Treasurer, one-half thereof when the work of construction begins and the remainder thereof when one-half of said improvement has been completed, which time shall be determined by the Board of Commissioners of said city with the advice of the City Engineer, be and the same is hereby ordered to be so constructed and reconstructed with concrete or other I improved paving material under the provisions of said law afore- said. SECTION 2. That all the cost incident to said construction of said street as provided in Section 1 hereof, except that part which shall be paid by the Federal or State Government shall be paid for wholly by the property owners of property abutting or fronting upon such improvement on both sides of said street, and to be apportioned to and assessed against said abutting property as pro- vided in Section 1 hereof. SECTION 3. When said work has been commenced, the Board of Commissioners with the advice of the City Engineer shall cause to be given to the owners of said property abutting upon such improvement so proposed to be made, a notice by the publication of an ordinance or resolution that said work jas commenced, and upon the publication of such resolution or ordinance the owners of such abutting property shall immediately pay to the City Treasurer the amount of one-half of the estimated cost of sucL i improvement as may be appropriated to said respective lots so aubtting thereupon, and when said work has been half completed said Board of Commissioners shall likewise publish a resolution or ordinance giving notice of the half completion thereof, and requiring the owners of the abutting property thereon to pay into the City Treasury the other one-half of said cost of said i improvement so to be assessed against said property and a)portioned thereto as aforesaid, and which payments shall be made immediately upon the publication of such notices as herein provided. SECTION 4. Page 193 I This ordinance shall be introduced at a regulat meeting of the Board of Commissioners, and remain on file for not less than one (1) week for public inspection inits completed form in which it shall be put upon its final passage, and upon its adoption it I shall be in full force and effect ten (10) days thereafter.
