OF PADUCAH, 10CRACKEN COUNTY, KENTUCKY, WITH ALL NECESSARY i MANHOLES, INTAIES, CATCH BASINS, SEWER AND DRAIN PIPES, AND ALL NECESSARY ENGINEERING, ADVERTISING AND LEGAL AND CLERICAL SERVICES IN CONNECTION THEREWITH, U11DER THE PROVISIONS OF AN ACT OF THE GENERAL ASSE11BLY OF THE C014YONWEALTH OF KENTUCKY ADOPTED AT ITS REGULAR SESSION IN 1938 PROVIDING .FOR THE IMPROVEMENT OF PUBLIC WAYS IN CITIES OF THE SECOND CLASS BY AID OF THE WORK PROJECTS ADIINISTRATION OR OTHER AGENCIES OF THE j FEDERAL OR STATE GOVEF,NP+IENT, AND AT THE EXCLUSIVE COST OF THE OWNERS OF REAL ESTATE ABUTTING ON SUCH IMPROVEMENT ACCORDING i TO THE NUYBER OF FRONT OR ABUTTING FEET, AND PROVIDING THAT A TAX SHALL BE LEVIED UPON RAID LOTS OR PARCELS OF REAL ESTATE FOR THE PAYI<IEINT OF THE COST ASSESSED THEREON AND WHICH COST SHALL BE THE DIFFERENCE BETWEEN THE TOTAL COST OF C014PLETING SAID IMPROVEMENTS AND THE TOTAL A14OUNT OF THE CONTRIBUTION OF THE WORK PROJECTS AD14INISTRATION OR OTHER AGENCIES OF `IIiE FEDERAL OR STATE GOVERNMENT ENGAGED IN MAKING SAID IMPROVEMENT, AND WHICH TAX SHALL BE DUE AND PAYABLE AT THE OFFICE OF `IL3E CITY TREASURER, ONE-HALF THEREOF WHEN THE WORK OF CONSTRUCTION BEGINS A'D THE REP1fAINDER THEREOF ;HEN ONE-HALF OF SAID I1,°PROVEP:'ENT5 SHALL HAVE BEEN COMPLETED, WHICH TITIE SILIALL BE DETERIdINED BY THE BOARD OF COIJI,!ISSIONERS WITH THE ADVICE OF THE CITY ENGINEER BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUEAH, KENTUCKY: i SECTION 1. That the driveway on Park Avenue from the West property line of 9th Street to the existing paving at 10th Street in the City of Paducah, Kentucky, with all necessary manholes, intakes, catch basins, sewer and drain pipes and all necessary engineering, advertising and legal and clerical services in connection therewitT under an Act of the General Assembly of the Commonwealth of Kentucky adopted at its Regular Session in 1938, providing for the improvement of public ways in cities of the second class by aid ofl. the Work Projects Administration or other Agencies of the Federal or State 0overnment, and at the ex1lusive cost of the owners of real estate abutting on such improvement to be a)portioned on such improvement according to the number of front or abutting feet, and Page 189 providing that a tax shall be levied upon said lots or parcels of real estate for the payment of the cost assessed thereon, and which P cost shall be the difference between the total cost of completing said improvement and the to amount of the contribution of the Work Projects Administration or other Agencies of the Uederal or State Government engaged in making said improvement, and which tax shall be due and payable at the office of the City Treasurer, one-half thereof when the work of construction begins and the remainder thereof when one-half of said improvement has been completed,w hich time shall be determined by the Board of Commiss- ioners of said city w ith the advice of the City Engineer, be and the same is hereby ordered to be so constructed and reconstructed with conctete or other improved paving material under the providions of said law aforesaid. SECTION 2. Mat all the cost incident to said construction of said street as provided in Section 1 hereof, except that past which !shall be paid by the Federal or State Government shall be paid for wholly b/ the property owners of property abutting or fronting upon such improvement on both sides of said street, and to be apportioned to and assessed against said abutting property as provided in Section 1 hereof. SECTION 3. When said work has been c ommenced, the Board of Commissioners, with the advice of the City Engineer, shall cause to be given to the owners of said property abutting upon such improvement so proposed to be made a notice by the publication of an ordinance or resolution that said work has commenced, and upon the publication of such resolution or ordinance the owners of such abutting property shall immeda telt' pay to the City ,Treasurer the amount of one-half of the estimated cost of such improvement as may be apportioned to said respective lots so labutting thereupon, and when said work has been hale completed said(! Board of Commissioners shall likewise publish a resolution or I ordinance giving notice of the half completion thereof,a nd requiring .the ovmers, of the abutting property thereon to pay into the i City Treasury the other one-half of said cost of said improvement so to be assessed against said property and apportioned thereto as aforesaid, and w hich payments shall be made immediately upon the !publication of such notices as herein provided. i SECTION 4. Page 190 i This ordinance shall be introduced at a regular meeting of 1 I, li the Board of Commissioners, and remain on file for not less than one (1) week for public inspection in its completed form in which it shall be put upon its final passage, and upon its adoption it shall be in full force and effect ten (10Y days 'I thereafter.
