HomeMy WebLinkAboutOrdinances Book 10, Page 1554, No Resolution Number1554 A RESOLUTION PROVIDING FOR THE EXECUTION OF AN INJUNCTION BOND IN THE SUM OF $3000.00 BY THE CITY OF PADUCAH PURSUANT TO THE ORDER OF THE McCRACKEN CIRCUIT COURT ENTERED IN .THE ACTION OF THE CITY OF PADUCAH, ET AL VS. KENTUM UTILITIES C014PAMY ON DECEMBER 16, 1946, AND AUTHORIZING THE CITY MANAGER TO ARRAVGE '1tiITH A BONDI COMPANY TO EXECUTE SAID BOND AS SURETY FOR THE CITY OF PADUCAH. WHEREAS, in the action of the City of Paducah, et al. vs. Kentucky Utilities Company now pending in the McCracken circuit Court, an order was entered on December 16, 1946 directing the clerk of said court to issue an order of in- junction requiring the defendant to have its appraiser, J. Samuel Hartt, proceed with the appraisal of the electric utility system of the Kentucky Utilities Company as provided in said order when the plaintiff, City of Paducah, shall tender or file before said clerk a bond with approved surety, obligating the plaintiffs and the surety to pay to the defendant such damages as it may slzstain, not exceeding however the sum of $"3000.00, if it is decided that said order of injunction should not have been entered; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COAIIdISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SEC TION 1. That the City of Paducah, Kentucky execute and deliver to the Kentucky Utilities Company a bond in the sum of ;,'3000.00, the condition of said bond being that the City of Paducah will pay to the Kentucky Utilities Company such damages as it may sustain not exceeding however the sum of $3000.00 by reason 'of the compliance by the Kentucky Utilities Company with the provisions of the aforesaid order of injunction of December 16 , 1946 if it is finally decided that said in- junction order Should not have been granted; that the Mayor is hereby authorized and empowered to execute said bond, with the attestation of the city clerk for and on behalf' of the City of Paducah, a'copy of which bond is filed herewith and made a part of this Resolution to the same extent as if fully copied herein, and the City Manager shall be authorized to arrange with is bonding company to execute said bond as surety for the City of Paducah and to pay the premium therefor, the amount of such �pre3lium to be charged to the contingent fund. 1555 SECTION 2.
