HomeMy WebLinkAboutOrdinances Book 10, Page 1542, No Ordinance NumberAN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING COMMISSION PROVIDING FOR THE PLACING OF BUILDING RESTRICTIONS ON CERTAIN PROPERTY ON KENTUCKY AVENUE BETWEEN 17TH AND 19TH STREETS, AND PRESCRIBING THE PENALTY TO BE IM00SED FOR VIOLATION OF SAID RESTRICTIONS AS SET FORTH IN A RESOLUTION ADOPTED BY THE CITY PLANNING AND ZONING COMMISSION ON DECEMBER 9TH, 1946. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SEC TION 1. That upon the recommendation and request of the City Planning and Zoning Commission as shown by its final report embodied in a resolution adopted by it on December :9, 1946 no person, firm or corporation shall be permitted to construct within the hereinafter described business district or zone any building or buildings for use in connection with the operation of a single business enterprise if the building or all of the units comprising said business enterprise shall cost less than 17500.00. Said business district or zone to be affected by the aforesaid restrictions being more particularly described as follows: "Being on the south side of Kentucky Avenue and extend- ing from the southwest corner of the intersection of 17th & Kentucky Avenue to a point 212 feet west of 17th Street, and on the north side of Kentucky Avenue extending from the northwest corner of the intersection of 17th and Kentucky Avenue to a point 165 feet west of 17th Street and extending back on both the south and north sides of Kentucky Avenue to the center of the block". SEC TION 2. Any property owner, tenant or other person who erects, constructs or reconstructs any building in violation of or contrary to the aforesaid provisions of this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less than j10.00 nor more than 4100.00 for each offense so committed and each day such offense is committ shall be deemed a separate offense and shall be subject to a separate penalty under the provisions hereof, or the person so offending or so guilty of violation of the provisions hereof, may, in addition to such fine be imprisoned not more than fifty (50) days at the discretion of the Judge or Jury trying the case. SECTION S. This ordinance shall be in full force and effect from and after its adoption.
