HomeMy WebLinkAboutOrdinances Book 10, Page 1527, No Ordinance Number1527 p /S AN ORDINANCE AUTHORIZING THE EXECUTION OF A CONTRACT WITH BL 'CK AND VEATCH, CONSULTING ENGINEERS FOR THE PREPARATION OF PLANS FOR SEWER FACILITIES IN THE CITY OF PAD.CAH, KENTUCKY, AND AP- PROPRIATING THE SUNT OF NOT EXCEEDING $40,000.00 FOR THE SERVICES TO BE RENDERED BY THEM IN THE PREPARATION OF SAID PLANS. WHEREAS, the Federal Works Agency has approved an advancement to the City of Paducah in the sum of $40,000.00 for the purpose of plat✓ breparation for construction of sewer facilities consisting o intercepting sanitary sewers, sewage pump stations and sewage disposal plant; and, WHEREAS, it will be necessary for the City of Paducah to employ consulting engineers for the preparation of said plans; NOi! THEREFORE, BE IT ORDAINED EY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION ONE That Black and Veatch, Consulting Engineers, of Kansas City, Missouri, be employed by the City of Paducah to prepare the plans for the construction of sewer facilities in said city, and the May and the City Clerk are hereby authorized,for and on behalf of the City of Paducah, to enter into a contract of employment with the said Black and Veatch, said contract to contain the foll-3wing term , conditions and covenants: "That in consideration of the mutual covenants herein contained, the City herein agrees to employ the engineers to perform th services hereinafter mentioned, and agrees to pay them for such services according to the schedule of fees herein con- tained. A. The services which the Engineers hereby agree to perform are: 1. To make all field studies, topographic surveys, test borings, flow investigations and all other work as necessary to determine the correct size, construction and location of an intercepting sewer along the Ohio River together with such necessary appurtenances as diversion manholes, pump stations, force mains, gravity sewers and manholes so that the sanitary sewage of the present City and of such territory as may be reasonably expected to become part of the City within the next fifty years, may be removed from the Ohio River and conducted to a point of treatment prior to discharge into the Ohio River - all as outlined in the approved ap- plication of the City to the Federal Works Agency Bureau of Community Facilities under Docket Ky-15-P-141 Sewer Facilities. 2r To make all field studies, topographic surveys, borings, flow investigations, sewage analysis, etc., as necessary to determine a proper site for sewage treatment and also the pamper size, method and degree of treatment to contro: the pollution of the Ohio River at Paducah. 3. To prepare detailed construction plans, drawings, specifi- cations and all contract documents to enable the City to participate in a governmental program for the alleviation of pollution in the Ohio River and to award construction contracts to build the proposed intercepting sewer and treatment works. 1528 4. To consult with the Kentucky State Board of Health and of er governmental agencies having an interest in the matter to the end that all detailed plans, specifications, etc., shall be approved by the governmental agency having jurisdiction. 5. To furnish the City now ten (10) complete sets of pland, specifications, etc., as finally approved by the Kentucky State Board of Health and to furnish the City at the time of receiving construction contract proposals with suffici nt set of plans, etc. to receive construction bids. 6. To prepare a detailed construction cost estimate of the proposed construction in sufficient detail that changes in unit construction costs may be applied to the unit items so that an estimate of cost can be readily prepared at the time of receiving construction proposals. 7. To personally deliver the final drawings, etc., to the Ci y and interested governmental agencies, to explain the same in detail, to assist the City in arranging for financing the con6truction program either in whole or in part and to be present when construction bids are received, to evaluate he same and to advise the City as to award of contracts. 8. The services to be performed by the Engineers under items A-1 through A-7 shall be fully rendered and the final drawings, specifications, and all other documents required to be prepared thereunder shall be completed and filed with the Board of Commission- ers within a period of ten months from the date on which the CdLty shall give to the Engineers notice provided for in Section 3 of Paragraph "B". 9. To execute and deliver to the City of Paducah a bond in the penal sum of X40,000.00, conditioned upon the faithful performance of its duties under th6s contract, said bond to be in form and substance satisfactory to the City. B. The City agrees to - 1. Cooperate fully with the engineers in the preparation of these plans etc., by furnishing prints of all constructs drawings, eic., of the present sewers, to allow the engir. to use space in the City Engineer's office as a field office and to assist the engineers in securing correct descriptions of property for right of way, plant site, etc., and to review the contract documents as to legal items. 2. To pay the Engineers for the services described above and items A-1 through A-7 a sum equal to five percent (5%) of the estimated cost of construction, exclusive of lands an right of way, as prepared under Item A-6 above by the Engineersand as agreed to as a fair and just cost estimat by the City Engineer, and provided that all payments to t Engineers shall be solely from funds received by the City from the Federal Works Agency under the terms of an agree ment between the City and the Federal Works Agency provid for the financing of this advanced planning program and according to the following schedule, and provided further that in no case shall the engineers be entitled to a sum in excess of fort( thousand dollars $40,000.00) for the services described in paragrapki A, above. Payments to the engineers shall be made at the rate of four thousand dollars (14,000.00) per month for the first six (6) months after start of work on this pro- ject and the balance being due and payable upon the delivery of final plans, estimates, contract documents, etc., to the City. 3. To notify the Engineers when to start wprk on this pro- ject and to advise them prior to any change or modifica- tion of the agreement between the City and the Federal Works Agency as to financing of this engineering contract; C. It is mutually agreed and understood that payments for service) under this contract shall be made by the City to the Engineers) solely from funds received by the City from the Federal Forks Agency, Bureau of Community Facilities under docket Ky-15-P-141 Sewer Facilities for this purpose and the City shall be in no way obligated for any expenditure of its own funds to fulfill the provisions of this contract." 1529 SEC TION TWO That the sum of not exceeding $40,000.00 be, and the same is here- by appropriated for payment of the fees which will become due and ay - able to the said Black and Veatch under the aforesaid employment c n - tract, but said fees shall be payable solely from the funds receiv d by the city from the Federal l7orks Agency. SECTION THREE This ordinance shall be introduced at a regulag meeting of the Eoard of Commissioners and remain on file for public inspection on week in the completed form in which it shall be put upon its final passage, and if adopted it shall be in full force and effect ten ( 0) days thereafter.
