HomeMy WebLinkAboutOrdinances Book 10, Page 1515, No Ordinance NumberAN ORDINANCE REPEALING SECTION 2 OF AN ORDINANCE ENTITLED: "Aid ORDINANCE PROVIDING FOR THE CLOSING OF A PUBLIC ALLEY SIXTEEN FEET IN WIDTH RUNNING FROLI THE SOUTIERLY LINE OF VASSEUR AVENUE 130.0 FEET ALONG THE REAR OF THE PROPERTY OF T. A. JONES & SONS FRONTING ON THE ;TEST SIDE OF BRIDGE STREET, PROVIDING FOR THE ACCEPTANCE OF A DEED OF DEDICATION UNDER 11HICH THE OWNERS OF SAID PROPERTY SHALL DEDICATE FOR USE AS A PUBLIC ALLEY CERTAIN STRIPS OF GROUND AT THE REAR OF THE LOTS FRONTING 182 FEET ON TIS WEST SIDE OF BRIDGE STREET; AND AUTHORIZING THE CORPORATION COUNSEL TO INSTITUTE IN THE 1-4aCRACKEN CIRCUIT COURT A SUIT FOR THE PURPOSE OF HAVII(I LEGALLY CLOSED THE ALLEY AUTHORIZED T6 BE CLOSED UNDER T:.IS ORDINANCE" WHICH WAS ADOPTED B:= Th.E BOARD OF COLI.ISSIONERS ON SEPTEI.1BER 17, 1946 WhEREAS, under Section 1 of an ordinance adopted by the Board of Commissioners on September 17; 1946, the City of Paducah authorized the closing of a portion of a sixteen foot public alley in the rear of the T. A. Jones Cold Storage Plant in Paducah, Kentucky, said alley to be closed extending from the south side of Vasseur Avenue toward Wall Street a distance of 130 feet and, WHEREAS, under Section 2 of said ordinance it was recited that Dr. Edward Adams, and others, ovmers of the property within the block through which the aforesaid alley extended, had agreed to dedicate to the City of Paducah as a public alley the sixteen foot strip of ground running through said lot from the north side of Wall Street to the south line of that portion of the aforesaid alley to be closed; and, WHEREAS, the strip of ground running through said block from the south side of Wall Street is shovin on the plat in the office of the City Engineer of Paducah, Kentucky, as a public alley and has always been recognized as such by the owners of the property within said block and, WHEREAS, it appearing that the aforesaid strip of ground to be dedicated as a public alley and as provided in Section 2 of said ordinance is now and has always been a public, alley and is open for use for the traveling public and that the formal dedication of the same as a public alley is unnecessary 1516 NOV THEREFORE, BE IT ORDAINED BY THE BOARD OF COLI:iISSIONERS OF THE CITY OF PADUCAH, IEMTUCKY: SECTION 1. That Section 2 of an ordinance entitled: "AN ORDINANCE PROVIDING FOR THE CLOSING OF A PUBLIC ALLEY SIXT EN FEET IN :7IDTH RUNNING FROI.i TH E SOUTHERLY LINE OF VASSEUR AVENUE 130.0 FEET ALONG THE REAR OF THE PROPERTY OF T. A. JONES & SONS FRONTING ON THE WEST SIDE OF,BRIDGE STREET, PROVIDING FOR THE ACCEPTANCE OF A DEED OF DEDICATION UNDER WHICH THE OWNERS OF SAID PROPERTY SLALL DEDICATE FOR USE AS A PUBLIC ALLEY CERTAIN STRIPS OF GROUND AT THE REAR OF THE LOTS FRONTING 182 FEET ON THE VIEST AIDE OF BRIDGE STREET: AND AUTHORIZING THE CORPORATION CUUNSEL TO INc>TITUTE IN THE McCBACKEN CIRCUIT COURT A SUIT FOR THE PURPOSE OF HAVING LEGALLY CLOSED THE ALLEY AUTHORIZED TO BE CLOSED UNDER THIS ORDINANCE" which was adopted by the Board of Commissioners on September 17, 1946, said section providing for the acceptance by the City of Paducah of a deed of dedication of the aforesaid strip of g round sixteen (16) feet in width runn through said block from the north side of Wall Street to that portion of the aforesaid alley to be closed, be and the same is hereby repealed. SECTION 2. This ordinance shall be in full force and effect from and after its adoption.
