CI N Lt] Q CL W / 1495 AN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING COMMISSION PROVIDING FOR THE ZONING OF PROPERTY ON LOTH SIDES OF JACKSON STREET FROM 25TH STREEPTO A POINT 50 FEET EAST OF THE EAST PROPERTY LINE OF 28TH STREET FOR RESIDENTIAL PURPOSES, AND PRESCRIBING THE PENALTY TO BE IIAPOSED FOR VIOLATION OF THE RESTRICTIONS SET FORTH IN A RESOLD ADOPTED BY THE CITY PLANNING AND 'ZONING COMMISSION ON SEPTEMBER 20TH, 1946, BE IT ORMNED BC THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That upon the recommendation and request of the City Planning and Zoning Commission as shown by its final report embodied in a resolution adopted by it on September 20th, 1946, all of the property on both sides of Jackson Street to the center of the block on either side from the 'Nest Property line of 25th Street to a point 50 feet East of the East property line of 28th Street, is hereby declared to be a residential district within the _ meaning of the City Planning and Zoning Commission Law and to be used for residential purposes only. SECTION 2. All property within said area is subject to the following restrictions: (1) In order to further promote the general welfare of the people in said district or zone aryl to enhance the desirability of said residential area or zone, no residence shall be erected on any residential building plot nearer than 30 feet to the front lot line, or nearer than 5 feet to any side lot line. No separate garage or other outbuilding shall be located nearer than 125 feet to the front lot line or nearer than 3 feet to any side lot line. (2) All lots in the above mentioned tract shall be known and described as residential lots, used and maintained for residential purposes only and no structure shall be erected, altered, placed or permitted to remain on any residential build- ing plot other than one detached single family or duplex apart- ment dwelling not to exceed two and one-half stories in height. (3) No residential lot shall be resubdivided into building plots having less than 7500 square feet in area or a width of less than 50 feet each. No lot shall be resubdivided with frontage on any street other than "ackson Street and all houses shall front upon Jackson Street. (4) No dwelling costing less than ;;'5000.00 shall be permitted on any lot in said tract and the ground floor square foot area of the min strut tore, exclusive of one story porches and garages shall not be less than 850 1 n the case of a one story structure nor less than 750 square feet in the case of a one and a half or tuo story structure. (5) No noxious or offensive trade or activity shall be carried on upon any lot nor shall anything be done thereon which may be or become an annoyance or nuisance to the neighborhood. r r 1496 (6) No trailer, basement, tent, shack, garage, barn or other outbuilding erected in the tract shall at any time be used as a residence temporarily or permanently, nor shall any residence of a temporary character be permitted except that this section shall not prevent guests or visitors of the residents of this area from occupying their own trailers for a period of not more than 30 days. SECTION 3. Any property owner, tenant or other person who erects, constructs or reconstructs any building in violation of or contrary to the aforesaid provisions of this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less than 410.00 nor more than 9100.00 for each offense so committed and each day such offense is committed shall be deemed a separate offense and shall be subject to a separate penalty under the provisions hereof, or the person so offending or so guilty of violation of the provisions hereof, may, in addition to such fine be imprisoned not mote than fifty (50) days at the discretion of the Judge or Jury trying the case. SECTION 4. This ordinance shall be in full force and effect from and after its adopted. Passed by the board of Commissioners, 0 c toff er 15, 1946.
