THE Pi;DUCAH BUS COI3PANY WHO ARE PARTICIPATING IN A STRIKE FOR HIGHER WAGES AIM A LONGER VACATION PERIOD, TO BRING TO A CONCLUSION AS SPEEDILY AS POSSIBLE THE LITIGA IOI%T INVLOVING THE CONTRACTUAL RIGHTS OL' THE PARTIES IN' Oi,DER THAT D -US SERVICE IN THE CITE OF PADUCaH is;AY BE Ifd.'1EDIATELt RESTORED :9HEREAS, on October 1, 1946, the employees of the Faducah Bus Company and members of the local union known as Division 1150 of Amalgamated Association of Street, Electric Railway, and 1,11otor Coac Employees of America, feeling themselves aggrieved by reason of the refusal of the Paducah Bus Company to comply with t:'eir demand by increasing their wages and permitting them to have a longer vacatio period, or to submit the questions to arbitration as provided for under a contract entered into between the parties on recemver 1944, discontinued ti -e operation of busses upon the streets of the City of Faducah and are now on a strike; and, WHEREAS, it is claimed by the Paducah bus Company that the conttact which provides that said question shall be submitted to an arbitration board is no longer in force and effect and said company has instituted in the McCracken Circuit Court a suit under the Declaratory Judgment Act for a judgment on the question as to whether said contract is or is not in force; and, 'NHEREAS, the interruption in the bus service as a result of sa strike has caused great inconvenience, expense and damage to the citizens of Paducah; and, -.7HEREAS, it is deemed advisable by the Board of Commissioners call upon the bus company and its employees for their cooferation in order that said stri'•ce may be immediately settled; and, 17HEREAS, it does not appear that there is any possibility that he part es can or will settle by agreement the dispute between them un it their rights under the aforesaid contract have been adjudged by the Court; and, 'EHEREAS, if it is determined by the 1,ourt whether or not said contract is enforcible, the aforesaid questions should be immediat settled by arbitration or agreement; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COGli^,I.:SIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Mary Deronda Stewart, owner of the Paducah Eus Company, her attorneys, and all of the employees of the iaducah Bus Company, members of the union known as Division 1190 of the Amalgamated Asso¢ia- tion of Street, Electric Railway, and Motor Coach Employees of America, and their attorneys, be urged to enter into an agreement substantially as follo�is: 1494 (1) That each and all of the employees of the Paducah Bus Company who are joined as defendants in the suit- filed by i:'sry arc Stewart, doing business as Paducah bus Company, as plaintiff, and V,, H. bazzell, et al, as defendants, enter their appearance to said action; (2) That the aforesaid suit be irmiediately placed on the -docket for trial and judgment under appropriate pleadings or upon a stipulation of facts; (3) That both the plaintiff and the defendants in said suit abide by the judgment of tLe Honorable Joe L. Trice, Judge of the :=cCracken Circuit Court, and that no appeal be taken from that judgment; and, (4) That all employees of the bus company resume their work as soon as said agreement has been entered into and the case has been docketed and submitted to the Court for judgment. SECTION T::10 That it is the belief and judgment of the Isiayor and the members of the �-oard of Commissioners that the party who shall fail or refuse to comply with the request contained in this resolution will be responsible for the continuance of said strike and should be held accountable by the people for the great in- convenience, expense and damages which will result from the lac'c of transportation facilities. 3ECTIOit TiiREE That a certified copy of this resolution be furnished to Lary Deronda Stewart, to the Secretary of Division 1190 of the Amalgamated Association of Street, Electric Railway, and Motor Coach Employees of Fmerica, and to the Sun Democrat.
