HomeMy WebLinkAboutOrdinances Book 10, Page 1491, No Ordinance Number-!- 1491 I/ AN ORDINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING COMMISSION PROVIDING FOR THE ZONING OF PROPERTY ON BOTH SIDES OF JACKSON STREET PROM 21ST STREET TO 25TH STREET FOR RESIDENTIAL PURPOSES, AND FRESCRIBING THE PENAL TO BE DIPOSED FOR VIOLATION OF THE RESTRICTIONS SET FORTH IPI A RESOLUTION ADOPTED BY THE CITY PLANNING AND ZONING COMMISSION ON SEPTEMBER 20th, 1946 BE IT ORDAINED BY THE BOARD OF CONVIISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That upon the recommendation and request of the City Planning and Zoning Commission as shown by its final report embodied in a resolution adopted by it on September 20th, 1946, all of the property on both sides of Jackson Street to the center of the block on either side from the ++est property line of 21st Street to the cast property line of 25th Street, is hereby declare to be a residential district within the meaning of the City Planni and Zoning Commission Law and to be used for residential purposes only. SECTION 2. In order to further promote the general welfare of the people in said district or zone and to enhance the desirability of same, all property within said area is subject to the following restrictions: (1) In order to further promote the general welfare of the people in said district or zone and to enhance the desirability of said resi- dential area or zone, no residence shall be erected on any residential building- plot nearer than 30 feet to the front lot line, or nearer than 5 feet to any side lot line. No separate garage or other outbuilding shall be located nearer than 125 feet to the fr-int lot line or nearer than 3 feet to any side lot line. (2) All lots in the above mentioned tract shall 'be known and e - scribed as residential lots, used and maintained for residential p poses only and no structure shall be erected, altered, placed or permitted to remain on any residential building plot other than one detached single family or duplex apartment dwelling not to exEeed two and one-half ' stories in height. (3) No residential lot shall be resubdivided into building pl having less than 7500 square feet in area or a width of less than 5 feet each. Any property owner, tenant or other person who erects, constructs or reconstructs any building in violation of or contrary to the aforesaid provisions of this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less than ,;10.00 nor more than .100.00 for each offense so committed and each day such offense is committ shall be deemed a separate offense and shall be subject to a separate penalty under the provisions hereof, or the person so offending or so guilty of violation of the provisions �,ereof, may, in addition to such fine be imprisoned not more than fifty (50) days at the -:incretion of the Judge or Jury tryin the case.
