HomeMy WebLinkAboutOrdinances Book 10, Page 1479, No Ordinance Number+ 1479% � C Q 0 LO ., Q w ELI AN ORDINANCE APPROVING TI.E PINAL REPORT OF THE CI'T'Y PLANNING AND ZONING CO1:II:".I2SION PROVIDINu FOR THE ZONING OF PROPERTY ON BOTH SIDES OF SOUTH 216T STREET FROM JACKSON STREET TO THE OLD MAYI?IELD ROAD FOR RESIDE14TIAL PURPOSES, AND PRESCRIBING THE PENALTY TO BE I1-1POSED FOR VIOLATION OF THE RESTRICTIONS SET FORTH IN A RESOLUTION ADOPTED B'f THE CITY PLANNING AND ZONING COMMISSION ON SEPTEMBER 20th, 1946 BE IT ORDAINED BY THE EOARD OP C013`11-�SIONERS OF THE CITY OF PADUCAH, KENTUCKY: SEC TION 1. That upon the recommendation and request of the City Planning and Zonine Commission as shown by its final report embodied in a resolution adopted by it on September 20th, 1946, the following described property is hereby declared to be a residential district within the meaning of the City PlanninC and Zoning Commission Law and to be used for residential purposes only. "Property on both sides of 21st Street from the !lest line of the present business zone on the Old Mayfield Road to the South property line of Jackson Street, to be zoned to the following depths: South side of 21st Street from the west line of the existing business zone on the Old Mayfield Road to Ohio Street, bac& for depth of 160 feet. West side of 21st Street from Ohio Street to Jackson Street back for a depth of 50 feet. North side of 21st Street from the existing business zone on the Old Mayfield Road to the East line of Lot 10, Block 3 Metzger's Addition between "C" Street and Jackson Street back for a depth of 180 feet." SEC TI ON 2. In order to further promote the general welfare of the people in said district or zone and to enhance the desirability Of same, all property within said area is subject to the following restrictions: (1) In order to further promote the general welfare of thl people in said district or zone and to enhance the desirability of residential area or zone, no residence shall be erected on any residential building plot nearer than 30 feet to the front lot line or nearer than 5 feet to any side lot line. No separate garage or other outbuilding shall be located nearer than 125 feet to the iron lot line or nearer than 3 feet to any side lot line. (2) All lots in the above mentioned tract shall be known described as residential lots, used and maintained for residential purposes only and no structure shall be erected, altered, placed or permitted to remain on any residential building plot other than one detached single family or duplex apartment dwelling not to exceed tw and one-half stories in height. iid id (3) No residential lot shall be resubdivided into buildinI dots having less than 7500 square feet in area or a width of less than 50 feet each. No lot shall be resubdivided with frontage on any street )they than South 21st and all houses shall front upon South 21st Street. 1480 (4) No dwelling costing less than :'5000.00 shall be permitte on any lot in said tract and the ground floor square foot area of the main structure, exclusive of one story porches and garages shal not be less than 850 in the case of a one story structure nor less than 750 square feet in the case of a one and a half or two story structure. (5) No noxious or offensive trade or activity shall be carri on upon any lot nor shall anything be done thereon which may be or become an annoyance or nuisance to the neighborhood. (6) No trailer, basement, tent, shack, garage, barn or other out -building erected in the tract shall at any time be used as a residence temporarily or permanently, nor shall any residence of a temporary character be permitted except that this section shall not prevent guests or visitors of the residents of this area from occup their own trailers for a period of not more than 30 days. SECTION 3. Any property owner, tenant or other person who erects, constructs or reconstructs any building in violation of or contrary to the aforesaid provisions of this ordinance, shall be ideemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less than •glO.00 nor more than K100.00 (for each offense so committed and each day such offense is committe, shall be deemed a separate offense and shall be subject to a separate penalty under the provisions hereof, or the person so offending or so guilty of violation of the provisions hereof, may, in addition to such fine be imprisoned not more than fifty (50) days at the Discretion of the Judge or Jury trying the case. SECTION 4. This ordinance shall be in full force and effect from and after its adoption.
