HomeMy WebLinkAboutOrdinances Book 10, Page 1463, No Ordinance Number1463 AN ORDNANCE AUTHORIZING THE COMPROMISE OF THE CONTROVERS BETWEEN THE CITY OF PADUCAH AND PETERS MOTOR COMPANY WITH REFERENCE TO THE VALIDITY OF THE CONTRACT UNDER INPICH SAID COMPANY AGREED TO SELL TO THE CITY FIVE (5) 1946 FORD DELUXE FORDOR SEDAN AUTOMOBILES FOR THE SUM OF $ 2872.05 AND BY ACCEPTING AS TRADE-IN FOR SAID NEW AUTOMOBILES POLICE CAR NOS. 1, 2, 3, 5 and 6; PROVIDING FOR THE APPROPRIATION OF THE ADDITIONAL SUNT OF $495.00 FOR PAYMENT OF THE REMAINDER OF THE PURCHASE PRICE FOR SAID NE".7 AUTOMOBILES AFTER CRE IT IS GIVEN FOR THE CARS TO BE TRADED IN, AND AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT FOR THE PURCHASE OF SAID AUTOMOBI nS WHEREAS, under an ordinance adopted by t e Board of Commissioners on June 18th, 1946, the City of Paducah accepted the bid of Peters Motor Company, Inc., in the sum of :2872.05 for the purchase of five (5) 1946 Ford DeLuxe sedan automobiles, said sum representing the difference between the sale price for said five (5) new automobiles and the trade-in values allowed by said company for police car Nos. 1, 2, 3, 5 and 6; and, WHEREAS, the original bid of Peters Motor Company, Inc. was submitted on April 30th, 1946 and the ordinance accepting its bid was not adopted until June 18th, 1946; and. WHEREAS, it is claimed by said company that on account of the lapse of time by reason of the necessity of advertising for bids, the introduction and adoption of an ordinance authorizing the acceptance of the bid, and the compliance with the provisions of t e Statutes relating to such transactions, said bid was not accepted within a reasonable time and said company is not obligated to sell said new automobiles at the aforesaid price; and, WHEREAS, it is further claimed by said company that it should be allowed the additional sum of ;837.15 by reason of the increase in the price charged by the manufacturer for said new aut9l mobiles since said bid was submitted, as well as the decrease in the O.P.A. ceiling price for the aforesaid automobiles to be traded in;l and, WHEREAS, the City of Paducah and Peters Motor Company, Inc, have agreed upon a compromise and settlement of the doubtful and disputed claim of said company that it is not obligated to sell aaid automobiles for the price stated in its original bid, the City of Paducah agreeing to pay the additional sum of $495.00 for said newt automobiles and the company agreeing to accept title to said used automobiles and the total sum of $3 367.05 in full payment v.` a , pa ent of the �;:,.n purchase price for said new automobiles. �K NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COIN-IISSIONERS OF THE CITY OF PADUCAH, KENTUCKY. 1464 SECTION 2. The total sum of 16?3,367.05 is hereby appropriated for payment of the remainder of the purchase price for the aforesaid ne automobiles after allowances have been made for police cars Nos. 1, 2, 3, 5 and 6 which are to be traded in, the amount thereof to be charged to the fund appropriated to the Police Department under the apportionment ordinance of 1946. SEC TION 3. All ordinances and parts of ordinances in conflict here- with are, to the extent of such conflict, hereby repealed. SECTION 4. This ordinance shall be in full force and effect from and after its adoption. Passed by the Board of Commissioners, August 27, 1946 Recorded by Rudy Stewart, City Clerk, August 27, 1946. SECTION 1. That the City of Paducah join with Peters Motor Company, Inc. in the execution of an agreement for the purpose of compromisi g and settling the aforesaid controversy with reference to the price to be paid by said city for the purchase of five (5) 1946 Ford Seda Automobiles, and that the City of Paducah pay to said company the additional sum of ?495.00, or the total sum of ?3,367.05 for said n w automobiles, said sum representing the difference between the sale price for said new automobiles and the trade-in values allowed by said company for the aforesaid used cars. The City Manager is he eby authorized to enter into a contract for the purchase of said auto- mobiles at that price, three of said automobiles to be immediately delivered and the other two to be delivered within a period of thir y ,(30) days. SECTION 2. The total sum of 16?3,367.05 is hereby appropriated for payment of the remainder of the purchase price for the aforesaid ne automobiles after allowances have been made for police cars Nos. 1, 2, 3, 5 and 6 which are to be traded in, the amount thereof to be charged to the fund appropriated to the Police Department under the apportionment ordinance of 1946.
