SEC TION 1. There is hereby created a board to be styled "Commissioners of ''laterworks" composed of three members to be appointed by the 1'ayor with the a.proval of the Board of Commissioners. They shall be legal voters and residents of the City of Paducah, shall be appointed at the expiration of the terms of office of the mem$ors of the Commissioners of "::aterworks noir serving, and shall serve without compensation for indefinite terms, subject to removal by the legislative body of the city for cause. In order that said commission may be nonpartisan and non- political, no person shall be appointed a member to succeed those persons now serving 1:rho7is related within the third degree to the L:ayov or any member of the legislative body of the city. The Commissioners now in office and those who will hereafter be appoint for indefinite terms shall not appoint to any subordinate office or -:osition of employment created by them any person who is related to any member of the legislative body or to the mayor or Chief executive of the city, or to any member of the commission. If at any time during his term of office any member of the commission becomes a candidate for any public office, he shall automatically vacate his office on the commission and another person shall be appointed. SECTIO11 2. Iach member of the Commissioners of 'i.'atere:orks now serving rhall continue to receive until the expiration of his respective term of office the sui of i'hroe ?!undrod (;300.00) Dollars per year as compensation for his services, pa;.rable out of the :income of said ':'aterworics :v!.ich may be assigned to operstinm expense, /2 7� the same to be paid in equal monthly installments until the expirai ion of his term. Each commissioner shall e:cecute a bond in the sum of Five Thousand (,5,000.00) Dollars for the folthful perfor- mance of his duties, the premium on such bond to Le paid as other operating expenses of the waterworks. 'P:.o members of the board shall constitute a quorum for the transaction of business. SECTION 3. 5n id Commissioners of "Yater :forks shall control and manage the water works and water system of the city subject to the limit- ations and recuirements of this ordinance and of the laws of the State of Kentucky. They shall is ve full power and authority to appoint and remove all employees of said water works and to fix and allo+ the compensation for such employees. Said commissioners of '::aterworks shall have the right and are hereby given power and authority to do any and all acts necessary or proper in the administration of said water works, except that in the lowering or raising Wates for service said Commissioners of '..ater arks shall matte their recommendations to the Board of Comm=ssioners of said City, or other legislative body of said City, and such rates so recommended shall not become effective until same have been ratified b./ the legislative authority of said city. Said Commissic of :datervior'.{s shall cause all of the income and revenues of said water works to be segregated into the proper funds, provided in an ordinance heretofore adopted by the ioard of Commissioners and providin^ for the issuance of bonds 'mown as 'nater 'r:orks Revenue Bonds for the purpose of purchasin; and acquiring said water works In the City of Paducah; and shall make and deliver to the Tlayor monthly reports in detail of all expenditures and of all collect- ions, and of the amount a; -:portioned to each fund aforesaid , and they shall have power and authority to select depositories and to require such depositories to execute bonds to secure the City and said Commissioners of :;aterworks and the holders of any bonds issued for the purpose of purchasing said water works against any loss or damage on account of loss, defalcation or misapplication of said funds. All of the funds collected and received in the operation,of said :rater works shall be deposited in said separate funds as herein provided, and as provided in said ordinance oro- vidin., for said water works bonds aforesaid. ::;:C TI011 4. The accounts of said water worka and the records of said Commissioners of '..'aterwor':s shall be audited and inspected once on ir.onth by the jiuditor of the City of Paducah and a report thereof made to the F.ayor, and all of the accounts, records and transactic of said Cormaiasioners of ':aterwor%s, and all of the records and accounts in connection with the -peration of said water wor,.s shal_ be audited by a certified public occ•untant once each year and a rerort hereof filed with the ;ayor of said City. The expense of h )q -yo 1441 making said annual audit shall be charged to the Operation and ;,aii tenance Recount of said water works. SECTION 5. Said Commissioners of Waterworks shall have power and authority to do any and all acts necessary and proper in the manag and operation of said water works, and to purchase all supplies an cause all work necessary in connection therewith to be done and na out of the funds available .for that purpose; they shall select all employees that may be necessary, includinZ a secretary or treasure: who shall be the employee charged with receivinC and accounting £o the funds and revenues of said water works. Said secretary or treasurer shall not be a member of said Commission, but he shall be required to execute a bond in the sum of Twenty &usand (;,20,0 Dollars to secure the faithful accountin- of all funds entrusted to him, which bond shall be continued in force and effect, and the premium thereon to be paid as other operating expenses and upo the cancellation or termination of any such bond the accounts of said secretar.� or treasurer shall be closed and an accountinG made thereof. Payments of all accounts of five (.;5.00) Dollars or more shall be by check, and all checks shall be drawn upon the proper account and sined by said secretary or treasurer. SECTION G. All ordinances and parts of ordinances in conflict herewith are to the extent of such conflict hereby repealed. SEC TION 7.
