HomeMy WebLinkAboutOrdinances Book 10, Page 1417, No Ordinance Number141.7/ „y � V L..f AN O;DINANCE RELATING TO TRAFFIC AND REGULATING USE OF PUBLIC STREETS IN THE CITY OP PADUCAH; DEFINING AIID ESTABLISHING PARKING METER ZONES AND REGULATING AND CONTROLLING AND PROVIDING FOR INSPECTION OF THE TIME PARKING OF VEPICLES THEREIN BY THE USE OF PARKING METNRS; PRESCRILING LIMITS OF TIME FOR PARKING IN PARKING METER ZONES; AND PROVIDING FOR ENFORCEMENT OF THIS ORDINAN, AND PUNISHIJENT FOR ITS VIOLATION BE IT ORDAINED BY TFE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. DEFINITIONS Whenever in this ordinance the following terms are used, they shall have the meanings respectively ascribed to them in this section: STREET. Every way set apart for public travel except alleyways, bridle paths and foot paths. ROA9.11AY. That portion of a street between the regularly establishe curb lines. SIDEINALK. That portion of a street between the curb lines and the adjacent property lines. VEHICLE. A conveyance propelled by motor power. PARKING METER ZONES, PARKING METER ZONES shall mean portions of str described and established by tYe City of Paducah as zones within which the parkin` of vehicles shall be controlled, regulated, and inspected with the aid of timing devices or meters, herein referred to as parking. meters or meters. SEC TION 2. The following portions of streets are hereby established as parking meter zones: X:l) That portion of Broadway from the west curb line of Second Street to the East curb line of Seventh Street extending fro the :%outh curb line of Broadway toward the center of said street a distance of seven feet and eight inches. (2) That portion of Broadway from the !;est curb line of Second Street to the East curb line of Seventh Street and extending from the North curb line of Broadway toward the center of said street a distance of seven feet and ei�7ht inches. SECTION 3. The City i.'anager is hereby authorized and directed to install meters in all parking zones hereby established or hereinaft established by the City of Paducah for the purpose of, and in such numbers and at such places as in his jud-Ment may be necessary to the regulation, control and inspection of the parking of vehicles ee is 1418 therein, including the reservation of loadin zones for commercial vehicles. SECTION 4. Parking meters installed in parkinn meter zones, shall be installed upon the curb immediately adjacent to the individual park'ng spaces hereinafter described, and each parking meter shall be so constructed and adjusted as to show when properly op -rated a signal that the space adjacent to which it is installed is or is not legally'. in use. SECT ON 5. The City of Paducah shall have lines or markin.-s painted upon the curb or street adjacent to each parking meter, deol`nating the parkir_7 space for which said meter is to be used, and each vehicle parked adjacent to any parking meter shall park within said lines or markings. It shall be unlawful to park any vehicle across any such line or marking, or to par', a vehicle in such a position that it shall not be entirely within the space designated by such lines or markings. SEC TION 6. It shall be unlawful for any person to cause, allow, permit, or suffer any vehicle registered in his name or operated or control by him to be upon any street within a parkin,, meter zone in any spa adjacent to which a parkin meter is installed. for mnra than n— hundred Twenty (120) consecutive minutes, or any time during which the meter is showing a signal indicating that such space is illegal in use --other than such time as is necessary to operate the meter t show legal parking --between the hours of 8 o'clock t,..". and 6 o1clo P.1F. of any day, iundays and legal holidays excepted. SEC TI OT: 7. Parking meters when installed and proprly operated, shall be so adjacent as to show legal parking during a period of twelve minutes upon and after the deposit therein of a United States one cent coin, twenty-four minutes upon and after the deposit therein o! two United States one cent coins, thirty-six minutes upon and after the derosit therein of three United States one cent coins, forty- eight minutes upon and after the deposit therein of four Jnited Stai one cent coins, sixty minutes upon and after the deposit thereof of five United States one cent coins or one United States five cent -oin, and one hundred twenty minutes upon and after the deposit therein of five United States one cent coins and one United States Cive cent coin or two United States five cent coins. It shall be unlawful to 7erosit or cause to be deposited in any parkins meter any slu", device, or metalic substitute for a one cent or a five cent coin of the United Jtates. SEC TION 9. It shall be unlawful for any unauthorized person to open, or for any person to deface, injure, tamper with, or wilfully Urea: destroy, or inpair the usefulnecs of any parkin" meter installed pursuant to this ordinance, br to hitch any animals thereto. S',CTIOIi 10• a It shall be the duty of the chief of the Police Department, by and through the employees of the department, and under the dirextion 7�m+.3o- of the City Council to keep account of all violations of this ordinance. (a) He shall 'coop an account of and report the number of' each parkin meter which indicates that the vehicle occupying the parkin, space adjacent to such parkin., meter is or has been parked in violation of any of the provisions of this ordinance, the date and hour of such violation, the make and the state license number of ouch vehicle, and any other !'acts a knoviedge of vhich:is necessary to thorouCh understandinr7 of the cireuristonces attending such violation. (b) He shall attach to such vehicle a notice stating that it has been parked in violation of this ordinance, and instructing the owner or operator to report to the Cit;; Judge in regard to succi violation. The owner or operator may, within twenty-four (24) hours after the time when such notice was attached to such vehicle, pay the City Treasurer, upon the order of the City Judge, in full satisfaction of such violation, the sum of fifty cents (50�) SECTION 11. Any perspn violating any provision of this ordinance stall be deemed guilty of a misdemeanor, and upon conviction thereof shall y� (� be punishable by a fine of not less than Ten (10.00) Dollars and n t exceeding One Hundred (.'r100.CO) -ollars or by imprisonment in the city �3a ail of the Cit o. Paducah for a j y period not exceeding Fifty (50) days or by both such fine and imprisonment. The provisions in thi paragraph are subject to the provisions of this ordinance. SECTION 12. The amount of the coins required to be deposited in parking �Z meters as provided herein is hereby levied and assessed as a fee tq 3f_/`/6 7 provide for the proper regulation, control, and inspection of traffic l6 upon the public streets, and to cover the cost of supervising, 37 regulatin,, and inspectin- the parking of vehicles in the parlcing meter zones provided for herein, the cost of placin7 and maintaining 1420 lines or markings designating parking spaces in parking meter zonet, and the cost of the purchase, supervision, protection, inspection installatlion, operation, maintenance, control, and use of the park:nm meters installed hereunder, and the special fund in which such fee shall be placed shall be devoted exclusively to those purposes. SECTION 13. It shall be the duty of the City Manager to designate some�<t "' P_ r(, person or persons to make regular collections of the money deposited in said parking meters, and delivering the money to the City Treas er; Viand it shall also be the duty of the City Treas;;rer to count the money and place it in a special fund to be known as the "Parking l? ter Fund," which fund shall be used exclusively for the purposes speciJ ied in Section 12. Such person or persons making such collections sha 1 be bonded in the sum of � e Thousand (;$,000.00) Dollars to insur the faithful performance of his or their duties. • SEC T .ON 14. This ordinance shall be deemed to be in addition and supple- mentary to, and not in conflict with, nor a repeal of existing ord - nances of this city, but shall be an additional provision for the regulation of traffic and parkin; in the parking meter zones provided for herein. SECTION 15. If anj section, part of section, sentence, clause, or phrase of this ordinance shall be held to be unconstitutional or invalid, the remaining provisions hereof shall nevertheless remain full force and effect. SECTION 16 . All ordinances or parts of ordinances or resolutions in con- flict with the provisions of this ordinance are hereby repealed. SECTION 17. This ordinance shall take effect and be in force on and after its final passage and adoption.
