HomeMy WebLinkAboutOrdinances Book 10, Page 1415, No Ordinance NumberAN O MINANCE APPROVING THE FINAL REPORT OF THE CITY PLANNING AND ZONING COIR ISSION PROVIDING FOR TII3 ZONING OP ALL OF THE PROP-_RTY ON BOTH SIDES OF MADISON STREET BETWEEN 19TH AND 24TH STREETS FOR RESIDENTIAL PURPOSES, AIdD PRESCRIBING THE PENALTY TO BE IAIP03ED FOR VIOLATION OF THE RESTRICTIONS SET FORTH IN A RESOLUTION ADOPTED BY THE CITY PLANNING AND ZONING C0131ISSION ON JULY 9th, 1946. BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. T).at upon the recommendation and request of the City Planning and Zoning Commission as shown by its final retort embodied in a resolution adopted by it on July 9th, 1946, all of the property on both sides of Madison Street between 19th and 24th Streets is hereby declared to be a residential district within the meaning of the City Planning and Zoning Comm- ission Law and to be used for residential purposes only. ^ SECTION 2. In order to further promote the general welfare of the people in said district or zone and to enhance the desirability of same, all property within said area is subject to the following restrictions: (1) In order to further promote the general welfare of the people in said district or zone and to enhance the desirability of said residential area or zone, no residence shall be erected on any residential building plot nearer than 30 feet to the front lot line or nearer than 5 feet to any side lot line. No separate garage or other outbuilding shall be located nearer than 125 feet to the iron lot line or nearer than 3 feet to any side lot line. (2) All lots in the above mentioned tract shall be known an xtpscribed as residential lots, used and maintained for residential Purposes only and no structure shall be erected, altered, placed or permitted to remain on any residential building plot other than one detached single family or duplex apartment dwelling not to exceed two and one-half stories in heiht. (3) No residential lot shall be resubdivided into building Plots having less than 7500 dquare feet in area or a width of less than 50 feet each. Any property oriner, tenant or, other person who erects, constructs or reconstructs any building in violation of or contrary to the aforesaid provisions of this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less than y;10.00 nor more than ;,100.00 for each offense so committed and each clay such offense is committe shall be deemed a serarate offense and shall be subject to a separate penalty under the provisions hereof, or the person so offending or so guilty of violation of the provisions hereof, may, in addition to such fine be imprisoned not more than fifty (50) days at the discretion of the Judge or Jury trying the case.
