OF ME PESTPICTIOIiS SZT FORTH Ii'+ A RESOLUTION ADOPTED BY Tia CITY PLANNING AND ZONING COL:I..I33ION ON NOVEiMER 16th, 1945 BE IT ORDAIP:ED BY THE -_CARD OF C014MIJ6IOUER3 OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That upon the recommendation and request of the City Planning and Zoning Commission as shown by its final report embodied in a resolution adopted by it on November 16th, 1945, a'1 of the property bounded on the East by the present Residential Zone between 24th and 25th 6treets, on the north by Mildred Street, on the ':lest by Thompson ':venue and on the South by Park Avenue is hereby declared to be a residential district within the meaning of the City Planning and Zonin Comr-lission Law and to be used for residential purposes only. 33CT_-OiT 2. In order to further promote the general welfare of the people in said district or zone and to enhance the desirability of same, all property within said area is subject to the following restrictions: (1). Ro residence or other structure shall be erected upon the property fronting in any way, except as the lot of land upon which it is built appears upon the plat as the front; nor shall any residence' esident or other structure be erected closer to the street in front thereof than the building line as shown on the plat, except that an open porch, r steps may extend not more than eight feet beyond the said building line. (2) No residence to be built on the property fronting on Pa. Avenue to cost less than ;15000.00. No residence to be built on 25th, 26tla Streets or Thompson Avenue to cost less than x.4000.00. (3) No building i3rected within said boundary shall be used . any purpose prohibited by law or ordinance, and in the use and occupancy of the buildings no nuisance shall be created nor permitb nor shall any building in said addition be so used as to become a nuisance to the owners of other lots. (4) No garage of any kind or out -building shall be erected nearer than thirty feet to the building line as shown on the plat of said district, except Lot 11 in Block jrl, Lot #6 in bloc,,' ;r4, Lot ,'1 in block fi4, Lot ;;3 in Block �7 and Lot rtl in Block jl, and on said excepted lots no garage shall be erected closer than fifteen feet to the side building line. However, a garage may be built with and as a part of the residence. (5) No building shall be erected upon any lot nearer than four feet to the side line of the lot, and on the corner lots where the side building lines are established no garage or other out -building shall be nearer than fifteen feet to the side building line. (6) No house shall be constructed with a flat roof, nor wit what is known as a false front flat roof upon any lot within said , boundary. (7) !o surface closet or toilet shall be permitted on any lglt. 1253 SECTION 3. Any property owner, tenant or other person who erects, constructs or reconstructs any building in violation of or contrary to the aforesaid provisions of this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not less than •n10.00 nor more than ;;100.00 for each offense so committed and each day such offense is committe shall be deemed a separgte offense and shall to subject to a separate penalty under the provisions hereof, or the person so offendinl- or so guilty of violation of tho provisions hereof, may, in addition to such fine be imprisoned not more than fifty (50) days at the discretion of the Judge or Jury trying the case. SSC TION 4.
