Y. L. Berry an assignment of its bid to the property at 2002 and 2JO4 Jackson Street purchased by said city at a Commissioner's sale held on Yarch 11th, 1940, pursuant to a judgment rendered uider Amended i'etition 7o. 48 in the V.G.Garner Branch of the suit instituted by the City of Paducah vs. J. •'ort Abell, et al.; and, :7HEREAS, it i:ras understood and a3reed between the parties said assignment that the said 'Irs. ... L. Berry would only assume and agree to pay the City and the State and County ad valorem taxe, due and payable in the year 1940 and in future years, the proceeds of the sale in said action to be applied in full settlement and satisfaction of all taxes to and includin;; the assessments due in the year 1939, but it is claimed that by the lanjuage used in said Assignment ��rs. Berry also assumed the payment of q11 taxes descrik in said judgment which were not paid out of the proceeds of the sal N911 T-1EnEFORE BE IT ORDAINED SY PHE -OARD OF COY?;:ISS IOiIER� OF T -_'E CITY OF PADLCAH, 1MITTUCKY: SECTION 1. That the City of Paducah, for the pur)ose of clarifyin; lanuage used in the aforesaid assignment and in order to vest in said rrs. ',".L.Berry all of its ri-ht, title and interest .in and to Its bid for the above described property accordln�, to the terms an conditions agreed upon between the parties at the tir,.e said bid we assigned, does hereby authorize and empower the E:ayor and City Cle: to execute and deliver to the said Sirs. L. Berry, for and on behalf of the City of Paducah, a corrected assignment of its bid for said property in consideration of the sum of :„350.00 heretof or, paid by her, and in consideration of her agreemebt to pay only those city and state and county taxes which became due in the year 1940.
