HomeMy WebLinkAboutOrdinances Book 10, Page 1127, No Ordinance Number1127✓ TAll ORDINANCE APPROPRIATING TIIE SUI:; OF $1200.00 TO `l'IIE ELECTRIC NT 130ARD OF `111B CITY OF PADUCAH TO PAY TIIE MCPENSE TO BE INCURRESAID BOARD FOR THE SERVICES OF All ATT07INCY RE"UIP,ED III COIINECTIOI WITH THE ACQUISITION OF TIIE ELECTRIC UTILITY SYSTEL OF TIIE KEIITUCKY 'UTILITIEJ COLIPANY, A11D PROVIDIIIG FOR "21113 REIAMLS-1411' OF SAID SUbI TO TIIE CITY OF PADUCAH FROM THE PROCEEDS DERIVED FROI,I THE SALE OF BCNDS ISSUED TO FINANCE THE PURCHASE OF SAID SYSTEM; '.'.MREAS, under and pursi.-,ant to the provisions of an ordinance adopted b;; the Board of Commissioners on January 30th, 1945, a boar known as the Electric Plant Board of the City of i-aducah has been appointed and has been granted all of the pourers and is charged with the faithful performance of all of the duties imposed upon it under the provisions of KMS 96,550 to 95,900 provided the powers therein delegated and the duties H erein imposed are not inconsistent with the contractual rihts acquired by the City of Paducah under the ordinance in which the electric franchise vias created and was thereafter sold to the Kentucky Utilities Company; and, WHEREAS, said board will require the services of an attor ey; a nd, 1.7HEREAS, it is provided under KRS 96,730 that all expense incurred by said board for legal services, as well as other expenses incurred in connection with the purchase of the electric system, mEy be paid out of the general fund and all such payments shall be con- sidered as temporary loans and shall be repaid immediately upon th sale and delivery of the bonds, and the claim for such repayment slall have priority over all other claims against the proceeds derived f om the sale of such bonds; z 1101.7 THEREFORE, BE IT ORDAINED BY TIIE BOARD OF COI,113ISSCONE S OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the stun of ,;1200.00 be, and the same is hereby appro riated to the Electric Plant board of the City of Paducah for the purpose of paying the expense incurred by it for the services of an attorn y required in connection with the acquisition of the electric utilit system of the Kentucky Utilities Company, and the amount so appropriated shall be charged to the Contin -gent fund upon the adop- tion of the Apportionment Ordinance for the year 1945. Said sura shall be repaid immediately upon the sale and delivery of bonds which are to be issued for the purpose of purchasing said system. SECTION 2. This ordinance shall, after its introduction and before i s adoption, remain on file at lease one week for public inspection i the completed form in which it shall be nut upon its final passagel 1128 and if adopted, it shall not go into offoct until the czpiration o ten days from and after its adoption.
