WHEREAS, the General Council of the City of Paducah, 'Kentucky, has heretofore, to -wit: on the day of 1920 adopted an ordinance entitled, "AN ORDINANCE PROVIDING FOR THEI/IMPROVE- MENT OF 25th STREET, FROM THE SOUTH PROPERTY LINE OF BROAD1:7AY TO THE . NORTH CURB LINE OF JACKSON STREET; KENTUCKY AVENUE,FR@M THE WEST CURB LINE OF 25TH STREET TO THE EAST CURB LINE OF 28TH STREET; 24TH STREET, .FROM THE SOUTH CURB LINE OF KENTUCKY AVENUE TO THE SOUTH PROPERTY LINE OF WASHINGTON STRTET; 4INA SHIN, GT„N STREET, FROM THE :FEST CURB LINE OF 24TH 'STREET TO THE EAST CURB LINE OF 25TH STREFT;,L•ITTLE AVENUE FROM THE SOUTH CURB LINE OF PAXTON AVENUE TO THE PRESENT CITY LIMITS LINE,,IN THE CITY OF Pi%DUCAH, KENTUCKY, BY THE GRADING AND GRAVELING OF SAME, TOGETHER WITH ALL NECESSARY I+IANHOLES, INTAKES, CATCH BASINS AND SEVIER PIPE CON- NECTIONS, IN ACCORDANCE 1lITH THE PLANS AND SPECIFICATIONS PROVIDED THERE- FOR BY THE CITY ENGINEER, AT THE vOST OF THE ABUTTING PROPERTY OiNERS, AND PROVIDING THAT THE COST OF SUCH CONSTRUCTION MAY BE PAID IN ACCORDANCE WITH THE PROVE. IONS OF THE TEN Yv.AR PAYMENT PLAN." and WHEREAS, in accordance with said ordinance, it was provided that the cost of the construction of said streets be paid by the abutting property owners on both sides thereof, except that portion to be paid by the city of Paducah, and as required by law: and I'ME%EAS, pursuant to said ordinance, a contract was entered into on the day of 19260 between Fraser & Cocke, ,ohtractors, and the City of Paducah, Kentucky, for the construction PAGE 81 thereof; and WHEREAS, said contract has in all respects been com- pleted and the work thereof finished and accepted b,,, the Board of Commissioners of tl,e City of Paducah, Kentucky, on the 25th day of April, 1928, pursuant to the recommendation made therefor by the Commissioner of Public Works of the City of Paducah, Kentucky, and pursuant to a motion made by said Commissioner, which motion was duly adopted by the Board of Commissioners; NOkI THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That all the property on both sides of Kentucky Avenue, from the Blest curb line of 25th Street to the East curb line of 28th Street; and on Vlashington Street, from the '.'Jest curb line of 24th Street to the East curb line of 25th Street; and on 25th Street, from the South property line of Broadway to the north curb lire of Jackson Street; and on 2dth Street, from the South Curb line of Kentucky Avenue to the South property line of !'Washington Street; and on Little Avenue, from the South curb line of Paxton Avenue to the old city limits, in the city of Paducah, Kentucky, be and the same is hereby assessed for the cost of construe ion of said streets, the sum of, gravel construction, 39 feet in width, $1.70 per abutting foor; gravel construction, 37 feet in width, $1.59 per abutting foot; gravel construction, 30 feet in width, $1.39 per abutting foot; interest $0.025107537 per one dollar of construction cost; engineering $0.020408547 per one dollar of construction cost, by grading and graveling same, as shorn by the Engineer's estimates on file in the office of the Commissioner of Public Works, which estimates are made part hereof. S'CTION 2. That all of the funds derived from the assessment of said property aforesaid shall be used for the purpose of paying off the tar, bills issued against said property, or such bonds as may be issued by the City of Paducah pursuant to Section 3101 of the Kentucky Statutes. SECTION 3. That. pursuant to Section 3101 of the Kentucky Statutes, as amended and re-enacted and now in force, said assessments may be, at the apt@pn of the property or+ners, payable in cash within thirty days from the date of the passing and recording of this Drdinance, or in ten annual installments, pursuant to the provisions DH said Statutes. PAGE 82 SECTION 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assessments herein provided for, and which may be paid on the ten year installment plan, as her,inbefore provided for, the City of Paducah may issue and sell improvement bonds, and to secure the payment of which bonds, there is hereby pledged such i taxes and liens upon the property assessed herein for the payment of the principal and interest on such bonds, but such bonds shall not be sold. for less than par, and the proceeds thereof applied exclusively to pay- ment for the improvement of said streets as hereinbefore mentioned, and such bonds, if issued, shall bear interest and shall be payable in accordance with'the provisions of Section 3101 of the Kentucky Statutes, as amended and re-enacted by the General Assembly of the Commonwealth of Kentucky and now in force and effect. SECTION 5. This ordinance shall take effect and be in force from and after its passage, record and publication.
