WHEREAS, the General Council of the City of Paducah, Kentucky, has heretofore, to -wit: on the X 7 daY of r 1927', adopted an ordinance entitled, "AN ORDINANCE PROVIDING FOR THE IMPROVE- 1-7.NT OF FLORA STRFET, FROM THP SOUTH PROPERTY LINE OF BRIDGE STRE•FT TO THE SOUTE CURB LATE OF HENDRICKS STREET; HENDRICKS STREET, FROM THE EAST CURB LINE OF FLORA AVFNUE TO IVATSON+S LINE; P0:71ELL STREET, FROM TEE EAST CURB LINE OF HAYS AVENUE TO THE WEST CURB LINE OF MILL STFFET, IN THF CITY OF PADUCAH, KENTUCKY, BY GRADING AND GRAVELING OF SAME, TOGETHER 17ITH ALL NECESSARY IAN+iOLES, INTAKES, CATCH BASINS AND SYNER PIPE CONNECTIONS:, IN ACCORDANCE '`ITH THE PLANS AND SPECIFICATIONS PRO- VIDED THF.RFFOR BY THE CITY ENGINEER, AT THF COST OF T"!D ABUTTING PROPERT' O'-!NERS, AND PROVIDING THAT THE COST OF SUCH CONSTRUCTION MAY BE PAID III i ACCORDANCE :'ITH THE PROVISIONS OF TIIE TEN YEAR PAYMENT PLAN," and WHEREAS, in accordance with said ordinance, it was Provided that the cost of the construction of said street be paid for by the abutting pboperty owners on both sides thereof, except that portion to be paid by the City of Paducah, as required by law; and ".TIIEREAS, pursuant to said ordinance a contract was entered into on the dqy of 1927, between E.L. Beyer, Contractor, and the City of Paducah, Kentucky, for the construction thereof; and :7HEREAS, said contract has in all respects been completed and the work thereof finished and accepted by the Board of Commissioners of the City cl Paducah, Kentucky on the 16th day of April, 1928s pursuant to the recommendation made therefor by the Commissioner eKentucky of Public ,Works of the City of aducah, Kenn tucky which mo/tion was duly adopted by the Board of Commissioners;:NOVI, TIIEREFORE, PAGE 49 BE IT ORDAIIIED BY THF BOARD OF COIIJMIz),.IOITERS OF THE CITY OF PADUCAII, KT'11';.UCKY: S73CTIOII 1. That all of the property on both sides of Flora Street, from the .'outh property line of Bridge Street to the South curb line of Hendricks Street; and on Itendricks Street, .from the � .ast curb line of Flora Street to l:Vatson's line; and on Powell Street, from the Fast curb line of Hays to the ":ee:t curb line of dill Street, in the City of Paducah, 117.entucky, be and the same is hereby assessed for the cost of the construction of said streets the sum of per abutting foot; interest and extra ,cork ti?0.044233426 per abutting foot; engineering ?'O.019662796 per abutting foot, by grading and graveling same, as shown by the rnuineer's estimates on file in the office of the Comriissioner of Public `forks, which estimates are made part hereof'; SECTION 2. That all the funds derived from the assessment of said property aforesaid shall be used for the purpose of paying off the tax bills issued against said property, or such binds as may be issued by the City of Paducah pursuant to Vection 3101 of the K-entucky Statutes. S70TIOIQ 3. That pursuant to Section 3101 of the K;ntucky Statutes, as amender' and re-enacted and now in force, said assess- ments may be, at the option of the property oriners, payable in cash within thirty days from the date of the passing and recording of this ordinance, or in ten installments, pursuant to the provisions of said Statutes. Sl?CTION 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assessments herein. provided for, and which may be paid on the ten year installment plan, as hereinbefore provided for, the City of Paducah may issue and sell improvement bonds, and to secure the payment of which bonds,' there is hereby pledged such taxes and liens upon the property assessed herein for the payment of the principal and interest on such bonds, but such bonds shall not be sold for less than par, and the proceeds thereof applied exclusively jo payment for the improve- ment of said streets as hereinbefore mentioned, and such bonds, if issued, shall bear interest] and shall be payable in accordance PAGE, 50 with the provisions of Section 3101 of the Kentucky Statutes, as amended and re-enacted by the General assembly of the Commonwealth of Kentucky and noer in force and effect.
