';IHEREAS, the General Council of the City of P11"I'c9h , Kentucky, has heretofore to -wit: on the day of 1927, adopted an ordinance entitled, "AN ORDINANCE PROVIDING FOR THE IMPROV.'-TTFNT' OF "4" STRRTfI', FROM THF NORTH CURB LINE OF GUT?TRIE AVETTUE, APPROXIMATELY 462 F7ET,• TO `SHE NORTH LINE OF '.',HEELER ADDITION; "B" STREET, FROM THF. SOUTH CURB LINE OF GUTHRIE AVENUE TO THE NORTH CURB LINE OF 21ST STRi'ET; "C" STREET, FROM THF SOUTH CURB LIVE OF GUTHRIa AVI?NUE TOTHE NORTH CURB LINE OF WNETLER AVENUE; T';JENTY FIRST STRE''T, FROM THE SOUTH CURB LINE OF JACKSVN STREFT TO THE ':JEST CURB LINE OF THE 1.1AYFIELD ROAD; T17ENTIETy STREET, FROM THE SOUTH CURB LINE OF ADAMS STRE'T TO THE NORTH PROPERTY LINE OF JACKSON STE:ET, IN THE CITY OF PADUCAH, KIENTUCKY, BY GRADING AND GRAVELING OF S: LIE, TOGETHER WIER ALL NECESSARY TSANHOLES, INTAKES, CATCH BASINS, AND SEWER PIPE COITNECTIONS, IN ACCORDANCE ''JITH THE PLANS AND SPECIFICATIONS PROVIDED THEREFOR BY THE CITY ENGINEFR, AT THE' COST OF THE ABUTTING PROPERTY O','JNERS, AND PROVIDING THAT THE COST OF SUCH CONSTRUCTION MAY BE PAID IN ACCOR"ANCE ::'ITH THE PRO- VISIONS OF THF TEN YEAR PAYT.TFUT PLAN," and 'iJHFREAS, in accordance with said ordinance, it was provided that the cost of such construction of said street be paid for by the abutting property owners on both .sides thereof, except that portion to be paid by the City of Paducah, as requAred by law; and PAGE 46 VRF REAS, pursuant to said ordinance a contract teas entered into on the day of 1927, between Fraser & Cooke, Contractors, and the City of Paducah, Kentucky, for the construction thereof, and 1;1HEREAS, said contract has in all respects been com- pleted and the work thereof finished and accepted by the Board of Commissioners of the City of Paducah, Keniiicky on the 16th day of April, 1928, pursuant to the recommendation made therefor by the Commissioner of -Public '"orks of the City of Paducah, Kentucky, and pursuant to a motion made by said Commissioner, which motion eras duly adopted by the Board of Commissioners; 11101.79 TDFRYPOR1;, ' BE IT ORDAII?ED L�Y TFL BOARD OF Coi.11ISSIO11ERS OF TF:E CITY OF PADUCAH, KEITUCKY: SECTION 1. That all of the propeity on both sides of "A" Street, from the North property line of Guthrie Avenue, approximately 462 feet to the North line of ':!heeler Addition; and on "B" Street, from the .South prope ty line of Guthrie Avenue to the North curb line of Twenty First Street; and on "C" Street .from the :south property line of Guthrie Avenue to the North curb line of ':reeler Svenue; and on Twenty First Street, from the South curb line of Jackson Street to the '.Jest curb :line oC the hayfield Road; and on Twentieth Street, from the South curb line of Adams Street to the North property line of Jackson Street, in the City of Paducah, Kentucky, be and. the same is hereby assessed for the cost of the construction of said streets the sum of F,1.60 per ,abutting foct; and for interest and extra work ;;0.039714325 per abutting foot; and for engineering 'p0.026838355 per abutting foot, by grading and graveling same, as shorm by the Fngineer's estimates on 'file in the office of the Commissioner of. Public :!orks, which estimates are made part hereof. SECTION 2. That all of the funds derived from the assessment of said property aforesaid shall be used for the purpose of paying off the tax bills issued against said property, or such bonds as may be issued by the City of Paducah pursuant to Section 3101 of the Kentucky Statutes'; SECTION 3. That pursuant to vection 3101 of the Kentucky Statutes, as amended and re-enacted and now in force, said assessments may be, at the option of the property owners, payable in cash :7:ithin thirty days from the date of the passing and recording of this ordinance, or in ten annual installments, pursuant to the provisions of said Statutes. PAGE 47 SECTION 4. In order to provide a fund for the immediate payment Of the cost of that portion of the special assessments herein provided for, and which may be paid on the ten year installment plan, as herein* -A provided for, the City of Paducah may :issue and sell improvement bonds, and to secure the payment of which bonds, there is her, -by pledged such taxes and liens upon the property assessed herein for the payment of the principal and interest on such bonds, but such bonds shall not be sold for less than.par, and the proceeds thereof applied exclusively to payment for the improve- ent of said streets as here mentioned, and. such bonds, if issued, shall bear interest, and shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes, as amended and re-enacted by the General Assembly of the Commonwealth of -entucky and now in force and effect. SECTION 5. This ordinance shall take effect and be in force rom and after its passage, record and publication.
