NECESSARY ENG PIEFFING, ADVERTISING AND LMAL AND CLEPICAL SERVICE IN CONNFCTION i THFRF.7!IZH AT THE COST OF THE ABUTTING PROPERTY 07!NERS AND PFOVIDING THAT SAME MAY BE CONSTFUCTF.D UPON THF TEN YEAR PAYiTENT PLAN," and i 77FEREAS, in accordance with said ordinance it is provided that the cost of construction of said driveway, together :with all necessary curb, gutter, driveways, manhole. intakes, catch basins, drain tile and sewer pipe, and all necessary engineering, advertising and legal and clerical service in connection therewith and all other wotk done thereunder be paid for by the abutting property owners on both sides thereof, except that portion to be paid by the City of Paducah as required by law, and WHEREAS, pursuant to said ordinance a contract was entered into on the day of 1929 between Southern Roads Company, Contractors, and the City of Paducah, Kentucky for the construction thereof, and 1,9HFF.EAS, said contract has in all respects been completed and the work thereunder finished and accepted by the Board of Commission- ers of the City of Paducah on the 27th day of November, 1929, pursuant to notice duly given and inspection of said work and the recommendation of acceptance made therefor by the Commissioner of Public Works of the City of Paducah, Kentucky, and pursuant to a motion made by said Commissioner, which motion was duly adopted by the Board of Commissioners, NOW, THEREFORE, BE IT ORDAINED BY THF BOARD OF COMMISSIONERS OF THE CITY OF PA DUCAH, ItENTUCKY: SECTION 1. That all of the property on both sides of Fourth Street, from the south property line of Madison Street to the south property j i line of Clay Street; and on Fifth Street, from the south property line of Madison Street to the south property line of Clay Street; and on Madison Street, from the west property line of Fourth Street to the east property line of Fifth Street; and on Harrison Street, from the west property line of Fourth street to the east property line of Eighth Street, except the intersections at Fifth and Harrison Streets, 6ixth and Harrison Streets and Seventh and Harrison Streets; and on Clay itreet from the east property line of Fourth Street to the west prow rty Page 448 line of Ninth Street, extent the intersection at Sixth and Clay I Streets, in the City of Paducah, McCracken County, Kentucky, as shown by the Engineer's Estimates, be, and the some is hereby assessed for the cost of construction of an improved, or asphalt street with all necessary curb, gutter, driveways, manholes, intakes, catch basins, drain tile and sewer pipe, and all necessary engineering, advertising and legal and clerical service in connection therewith. SECTION 2. That all of the funds derived from the assessment of said property afores^id shall be used for the purpose of paying off the tax bills issued against said property, or such bonds as may be issued by the City of Paducah pursuant to Section 3101 of the Kentucky Statutes. SECTION 3. That pursuant to Section 3101 of the Kentucky Statutes, as amended and re-enacted and now in force, said assessments may be, at the option of the property owners, payable in cash within thirty days from the date of the passing and recording of this ordinance, or in ten annual installments, pursuant to the provisions of said Statutes. SECTION 4. In order to provide a fund for the immediate payment of the :ost' of that portion of the special assessments herein provided for, End which may be paid on the ten year installment plan, as herein- )efore provided for, the City of Paducah may issue and sell .mprovement bonds, and to secure the payment of which bonds there is tereby pledged such taxes and liens upon the property assessed .erein for the payment of the principal and interest on such bonds, Page 449 but said bonds shall not be sold for less than par, and the proceeds thereof applied exclusively to payment for the improvement of said street as hereinbefore mentioned, and such bonds, if issued, shall bear interest and shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes, as amended and re-enacted by the General Assembly of the Uommonwealth of Kentucky and now in force and effect. SFCTlON 5. This ordinance shall take effect and be in force from and I after its passage, record and publication.
