I,VHPRFAS, the Board of Commissioners of the City of Paducah, Kentucky has heretofore on the 8th day of Anril, 1929 adopted an ordinance entitled, "AN ORDINANCE PROVIDINF FOR THE CONSTRUCTION n W RFCONSTPUCTION OF AN ALT,EY LYING BrTI,- FN BROADWAY !ND KFNTUCKY AVENUE, FROM THE %7EET PROPERTY LINE OF 6TH STREET TO THE FAST PF-OPFRTY LINE OF 7TH STREET, IN THE CITY OF PADUCAH, VcCRACKFN COUNTY, KENTUCKY, '„ITH iii NECESSARY CURBS, (:UTTERS, DF,IVE'.'AYS, MANHOLE,`, INTAKES , CATCH BASIN; , SE7.1ERS AND DRAIN PIPE, AND ALL NECESSARY M11GIPIFERING, ADVERTIFING AND LEGAL AND CLERICAL SERVICE IN OC) NNECTION THEREWITH AT THF COST OF THE ABUTTING PROP-RTY 0"!NFRS AND PROVIDING T11AT EA1.7 MAY BE CONSTRUCTED UPON THE TEN YEAR PAYMTNT PLAN,” and WHEREAS, in accordance with said ordinance it is provided that the cost of construction 'of said alley, together with all iecessary curb, gutter, driveways, manholes, intakes, catch basins, Train tile and sewer pipe, and all necessary engineering advertising Ind legal and clerical service -in connection therewith and all other , rork done thereunder be paid for by the abutting property owners on )oth sides thereof, except that portion to be paid by the City of 'aducah as required by 1 w. and 'NHEREAS, pursuant to said ordinance, a contract was ntered into on the day of 1929, between J.M. Page 425 Rouse Contracting Company, and the City of Paducah, Kentucky for the construction thereof, and WHFREAS, said contract has in all respects been completed and the work thereunder finished and accepted by the Board of Commissioners of the City of Paducah on the 18th day of October, 1929, pursuant to notice duly given and inspection of said work and the recommendation of acceptance made therefor by the Commissioner of Public .7orks of the City of Paducah, Kentucky, and pursuant to a motion made by said Commissioner, which motion was duly adopted by the Board of Commissioners, , THFREFORF, BF IT ORDAINED BY THF BOARD OF COri;rU,-FIONFRS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That all of the property on both sides of the alley lying een Broadway and Kentucky Avenue, from the ,nest property line of Street to the East property line of 7th Street, in the City of aducah, Kentucky, as shown by the Engineerls Estimates, be, and the same s hereby assessed for the cost of construction of a concrete alley with necessary curb, gutter, driveways, manholes, intakes, catch basins, in tile and sewer pipe, and all necessary engineering, advertising legal and clerical service in connection therewith. SECTION 2. That all of the funds derived from the assessment of said perty aforesaid shall be used for the purpose of paying .off the bills issued against said property, or such bonds as may be issued the City of Paducah pursuant W Section 3101 of the Kentucky tutes. SECTION 3. That pursuant to 3ect-ion 3101 of the Kentucky Statutes, as mended and re-enacted and now in force, said ass¢ s may be, at the ption of the property owners, payable in cash within thirty days from he date of the passing and recording of this ordinance, or in ten nnual installments, pursuant to the provisions of said Statutes'; Page 426 SECTION 4. In order to provide a fund for the immediate payment of the cost of that portion of the special assignments herein provided for,, and which may be paid on the ten year installment plan, as hereinbefore provided for,t.he City of Paducah may issue and sell improvement bonds, and to secure the payment of which bonds there is hereby pledged such taxes add liens upon the property assessed herein for the payment of the principal and interest on such bonds, but said bonds shall not be sold for less than par, and the proceeds thereof applied exclusively to payment for the improvement of said alley as hereinbefore mentioned, and such bonds, if issued, shall bear interest ^nd shall be payable in accordance with the provisions of Section 3101 of the Kentucky Statutes, as amended and re-enacted by the General Assembly of the Commone:ealth of Kentucky an,' nor in force and effect; SECTION 5. This ordinance shall take effect and be in force from land after its passage, record and publication.
